      Section 5 – Congress can make laws to enforce provisions of the Amendment. Test for laws pursuant to 14th Amendment. Can be preventative or remedial. However, must be solidly based in factual evidence of discrimination. Also, must be congruent and proportional. Examples of test applied: Religious Freedom. RFRA unconstitutional
