Therefore, we will disapprove appellant’s adjudged forfeiture. In taking this action we considered several factors. Appellant was sentenced on 17 March 2004. Appellant’s Enlisted Record Brief, included in the record of trial as Prosecution Exhibit 2, indicates appellant’s term of enlistment expired on 27 April 2004.

The convening authority took initial action in appellant’s case on 17 August 2002. While appellant was on excess leave he was not entitled to pay and allowances. His adjudged forfeitures of $500 pay for two months were not in effect while he was on excess leave, but they would have been in effect for any active duty period after 15 May 2002.
