The claimant fell from a ladder sustaining numerous injuries including an L5/S1 herniated disc with compression of the S1 nerve root resulting in a left "drop foot". Plaintiff had multiple surgical procedures including a lumbar discectomy/decompression with interbody fusion.

It revealed a 3 mm retrolisthesis of the L5 in relationship to the L4. It was thought that this was due to degenerative disc disease. At L4/L5, there was moderate disc degeneration with a 2 mm diffuse disc bulge, which did not compromise the nerve rootlets or the central canal. L5/S1 was also noted to have moderate disc degeneration.

Between his return to work following the August 22, 2007 injury and October 24, 2011, the Petitioner re-injured his back while getting into his personal vehicle. He missed several weeks of work.
