Military restricted countries

    • Does the enlistment in foreign service prohibition apply?

The enlistment in foreign service prohibition does not apply to citizens of countries at war with the United States, except to the extent they enlist others. The prohibition also does not apply to transient nationals of belligerent countries.

    • Is foreign military service legal?

International law permits such service, but a state’s internal law may prohibit it. U.S. nationals (including both citizens and other persons owing allegiance to the United States (8 U.S.C. §1101)) have performed foreign military service at various times since 1788.

    • Can a family member travel to a soldier's overseas duty station?

These Family members are not entitled to travel to and from the Soldier’s overseas duty station at Government expense, nor is the Soldier entitled to station allowances at the “with dependents” rate. This Family member may either be an “acquired dependent” or may enter the command without endorsement of the appro-priate authority.

    • Does the Foreign Enlistment law apply to nonstate groups?

Agreeing with nonstate groups to travel overseas and engage in an insurgency is not covered by the foreign enlistment law. Congress has the power to designate certain voluntary acts by U.S. nationals as expatriating, whereby committing those acts would result in the loss of U.S. nationality.
