What are the rules of being a notary?
Notary personally knows the individual who is requesting a notarial act. Signer provides a valid driver license, passport or other pictured state/federal issued personal identification card. Notary upon the oath or affirmation of a credible witness personally known by the Notary, and the witness personally knows the individual.
Is it illegal for a notary to notarizehis own document?
Notary laws do not allow it. Notary laws in all states strictly prohibit notaries from notarizing their own documents or notarizing documents when the notary is named as a party to the underlying transaction, has a financial or beneficial interest in the transaction, or is a signatory to a document.
Should notary keep copy of documents notarized?
Few circumstances require notaries to retain copies of notarized documents; certainly not routine affidavits or documents with acknowledgment acts. Some states do require notaries to keep copies of documents they certify as true copies. Unless state laws require it, though, we strongly advise against retaining copies of documents.
Can a notary notorize a living will?
No, a “living will” may be notarized normally. While there are an abundance of statutory rules for wills, this is not the case with “living wills.” Of course, all practices required by law, such as the signer appearing in person before the Notary and being positively identified, should be followed.
