No. 20 AN ACT relating to the creation, reorganization, and operation of certain district courts. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTIONа1.ааEffective September 1, 1997, Subchapter C, Chapter 24, Government Code, is amended by adding Sections 24.540 and 24.541 to read as follows: Sec.а24.540.аа395th Judicial District (Fort Bend County). The 395th Judicial District is composed of Fort Bend County. Sec.а24.541.аа396th Judicial District (Tarrant County). (a)ааThe 396th Judicial District is composed of Tarrant County. (b)ааThe 396th District Court shall give preference to criminal cases. SECTIONа2.ааEffective January 1, 1999, Subchapter C, Chapter 24, Government Code, is amended by adding Sections 24.524, 24.538, and 24.542 through 24.552 to read as follows: Sec.а24.524.аа379TH JUDICIAL DISTRICT (BEXAR COUNTY). (a)ааThe 379th Judicial District is composed of Bexar County. (b)ааThe 379th District Court shall give preference to criminal cases. Sec.а24.538.аа393RD JUDICIAL DISTRICT (BEXAR COUNTY). (a)ааThe 393rd Judicial District is composed of Bexar County. (b)ааThe 393rd District Court shall give preference to juvenile matters. Sec.а24.542.аа397th Judicial District (Harris County). (a)ааThe 397th Judicial District is composed of Harris County. (b)ааThe 397th Judicial District shall give preference to juvenile matters. Sec.а24.543.аа398th Judicial District (Galveston County). The 398th Judicial District is composed of Galveston County. Sec.а24.544.аа399th Judicial District (Travis County). The 399th Judicial District is composed of Travis County. Sec.а24.545.аа400th Judicial District (Nueces County). (a)ааThe 400th Judicial District is composed of Nueces County. (b)ааThe 400th District Court shall give preference to juvenile matters. Sec.а24.546.аа401st Judicial District (Tom Green County). The 401st Judicial District is composed of Tom Green County. Sec.а24.547.аа402nd Judicial District (Webb County). (a)ааThe 402nd Judicial District is composed of Webb County. (b)ааThe 402nd District Court shall give preference to cases involving family violence, cases under the Family Code, and cases under the Health and Safety Code. Sec.а24.548.аа403rd Judicial District (Fort Bend County). (a)ааThe 403rd Judicial District is composed of Fort Bend County. (b)ааThe 403rd Judicial District shall give preference to cases under the Family Code. Sec.а24.549.аа404th Judicial District (Cameron County). (a)ааThe 404th Judicial District is composed of Cameron County. (b)ааThe 404th Judicial District shall give preference to juvenile matters. Sec.а24.550.аа405TH JUDICIAL DISTRICT (SMITH COUNTY). The 405th Judicial District is composed of Smith County. Sec.а24.551.аа406TH JUDICIAL DISTRICT (BEXAR COUNTY). (a)ааThe 406th Judicial District is composed of Bexar County. (b)ааThe 406th District Court shall give preference to civil cases. Sec.а24.552.аа407TH JUDICIAL DISTRICT (BEXAR COUNTY). (a)ааThe 407th Judicial District is composed of Bexar County. (b)ааThe 407th District Court shall give preference to criminal cases. SECTIONа3.ааSubsection (f), Section 24.151, Government Code, is amended to read as follows: (f)ааIn Webb County, the clerk of the district courts shall file all civil cases, except tax suits, on the Clerk's Civil File Docket and shall number the cases consecutively. All tax suits shall be assigned and docketed in the 49th District Court. All cases involving family violence, all cases under the Family Code, and all cases under the Health and Safety Code shall be assigned and docketed in the 402nd District Court. All other [Each] civil cases [case, except tax suits,] shall be assigned and docketed at random by the district clerk according to the following percentages: 49th District Court, 20 percent; 111th District Court, 60 percent; and the 341st District Court, 20 percent. The clerk shall keep a separate file docket, known as the Clerk's Criminal File Docket, for criminal cases and a separate file docket, known as the Clerk's Tax Suit Docket, for tax suits. [Each tax suit shall be assigned and docketed in the 49th District Court.] The clerk shall number the cases on the Clerk's Tax Suit Docket consecutively with a separate series of numbers and shall number the cases on the Clerk's Criminal File Docket consecutively with a separate series of numbers. SECTIONа4.ааSection 24.384, Government Code, is amended to read as follows: Sec.а24.384.аа205TH JUDICIAL DISTRICT ([CULBERSON,] EL PASO COUNTY[, AND HUDSPETH COUNTIES]). (a)ааThe 205th Judicial District is composed of [Culberson,] El Paso County[, and Hudspeth counties]. (b)аа[The 205th District Court shall give preference to criminal cases. [(c)]ааSection 24.136, relating to the 34th District Court, contains provisions applicable to both that court and the 205th District Court. (c)ааThe 205th District Court has jurisdiction of the community supervision and corrections department that serves Hudspeth and Culberson counties. SECTIONа5.ааSection 24.185, Government Code, is amended to read as follows: Sec.а24.185.аа83RD JUDICIAL DISTRICT (PECOS, TERRELL, REAGAN, VAL VERDE, AND UPTON COUNTIES). (a)ааThe 83rd Judicial District is composed of Pecos, Terrell, Reagan, Val Verde, and Upton counties. (b)ааThe 83rd and 112th district courts have concurrent jurisdiction in Pecos, Reagan, and Upton counties. (c)ааThe 83rd and 63rd district courts have concurrent jurisdiction in Terrell and Val Verde counties. (d)ааThe terms of the 83rd District Court begin: (1)ааon the second [ninth] Monday [after the first Mondays] in January and July; (2)ааin Reagan County on the 14th Monday after the first Mondays in January and July; and (3)ааin Upton County on the 12th Monday after the first Mondays in January and July. (e)а[(d)]ааIn each of the counties of Pecos, Terrell, Val Verde, and Upton, a petition or other pleading filed in the district courts is sufficient if addressed "To The District Court of Pecos County, Texas," or "To The District Court of Terrell County, Texas," or "To The District Court of Upton County, Texas," or "To The District Court of Val Verde County, Texas," respectively, without giving the number of the district court in the address. [(e)ааThe secretary of state shall submit the changes made to this section by H.B. 3235 of the 74th Legislature, Regular Session, to the U.S. Justice Department for preclearance under Section 5 of the federal Voting Rights Act of 1965 as amended (42 U.S.C. Section 1973 et seq.). The changes made to this section by H.B. 3235 of the 74th Legislature, Regular Session, become inoperative if the U.S. Justice Department files a timely objection pursuant to Section 5 of the Voting Rights Act of 1965 as amended.] SECTIONа6.ааSection 43.133, Government Code, is amended to read as follows: Sec.а43.133.аа63RD JUDICIAL DISTRICT. (a)ааThe voters of the 63rd Judicial District elect a district attorney. (b)ааThe district attorney for the 63rd district also acts as district attorney for the 83rd Judicial District in Terrell and Val Verde counties. SECTIONа7.аа(a)ааThe local administrative district judge shall transfer all cases from Culberson and Hudspeth counties that are pending in the 205th District Court on the effective date of this Act to the 394th District Court. (b)ааWhen a case is transferred from one court to another as provided by Subsection (a) of this section, all processes, writs, bonds, recognizances, or other obligations issued from the transferring court are returnable to the court to which the case is transferred as if originally issued by that court. The obligees in all bonds and recognizances taken in and for a court from which a case is transferred, and all witnesses summoned to appear in a court from which a case is transferred, are required to appear before the court to which a case is transferred as if originally required to appear before the court to which the transfer is made. SECTIONа8.ааThe initial vacancies in the offices of judges of the 379th, 393rd, and 397th through 407th judicial districts shall be filled by election. The offices exist for purposes of the primary and general elections in 1998. Vacancies after the initial vacancies are filled as provided by Section 28, Article V, Texas Constitution.
