Justice system decision-makers are directed to consider whether the technology required to submit or access legal information may affect equal access to or administration of justice. Technology is defined as all electronic means of communication and transmission and all mechanisms and means used for the production, storage, retrieval, aggregation, transmission, communication, dissemination, interpretation, presentation, or application of information. ABOUT THE CHECKLISTS Two checklists were developed to help organizations establish internal expectations that promote the fundamental goals and objectives of the Access to Justice (ATJ) Technology Principles and that facilitate effective integration of the Principles into organizational decision-making and operations. This checklist for integration of the Principles into Organizational Culture & Operations is designed to facilitate a high level review of an organizations efforts to integrate the ATJ Technology Principles, and should be looked to as a guide for organizational leaders. The checklist for integration of the Principles into the Technology Development Lifecycle is designed to facilitate the timely consideration of key questions in the process of technology systems development and is a guide for system developers, program managers, and others involved in justice system technology projects. Together, the checklists will help organizations meet the expectations of equal access, achieving just outcomes and elimination of barriers that lie at the heart of the Principles. When necessary, specific actions should be defined and addressed to ensure integration of the ATJ Technology Principles. After the initial organizational review, the chief executive should establish a framework for subsequent biennial review. I. Organizational Awareness of the Access to Justice Technology Principles Are the organizations leaders and technology application managers aware of the existence, purpose of, substance and scope of the ATJ Technology Principles? NOTE: Judicial branch and justice system organizations are encouraged to identify a lead staff person to coordinate efforts to promote staff awareness of and integrate the ATJ Technology Principles into organizational initiatives. Duty to Incorporate the Access to Justice Technology Principles into Planning, Development and Execution of Technology Initiatives 1. Has the organization effectively communicated to its technology systems planners, developers and managers the duty to consider and integrate the values and expectations outlined in the Principles into organizational technology initiatives that might affect the publics access to the justice system? NOTE: Potential steps for communicating could include a new agency policy and procedures which require consideration and integration of the Principles, an email from the agency s executive, or a staff meeting or brief training providing an overview of the Principles and associated Court Order at http://www.00000000.org Yes. If so, by what means? No. If not, what action should be taken to ensure systematic communication of these values and expectations? 2. Have systems been established to intentionally integrate the ATJ Technology Principles into the organizations technology planning, development and implementation processes? NOTE: The ATJ Technology Principles Implementation Committee has developed a checklist and a template to facilitate effective consideration of the Principles into their technology system development lifecycle processes. Has someone within the organization been designated with responsibility to ensure that there is a consistent approach to implementation of the ATJ Technology Principles into relevant decision making processes? NOTE: The Court Administrator, Technology Manager, or Chief Financial Officer could be designated to ensure effective integration of the Principles at the organizational level. Yes. NOTE: The checklist for integration of the ATJ Technology Principles into the Technology Development Lifecycle, referenced above in Principle II:2, and in the introduction to this document is designed to allow planners to timely screen and assess the effect of technology initiatives on access to the justice system. Planners are encouraged to integrate this checklist into their technology system planning processes. Yes. If so, how has this been accomplished and communicated? No. If not, what if any, are the barriers? How can these be addressed? What action should be taken to ensure that the organizations leaders, managers and staff understand and embrace the organizations responsibility to promote access to the justice system? 2.
