Judge Darrell White then introduced himself, and advised those present of his duties. A Motion was made by Mr. Lambert and seconded by Mr. Graham to accept the Minutes of the February 17th, 2011 regular meeting. The Motion passed. No Special Guests were in attendance. NEW BUSINESS JUDGMENT HEARINGS: MDI Construction, L.L.C. (CL.40871) Administrative Hearing - Consider an alleged violation by MDI Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 19th Judicial District Court, No. 594003, Parish of East Baton Rouge, State of Louisiana, on the 19th day of October, 2010, in which MDI Construction, L.L.C., holder of Commercial Contractors License number 40871, was ordered to pay in the full sum of SIXTEEN THOUSAND THREE HUNDRED NINETY SIX DOLLARS AND 88/100 ($16,396.88) together with 15% penalties, legal interest thereon from date of judicial demand until paid, attorneys fees in the sum of $3,280.00 and for all costs of the proceedings in favor of Baton Rouge Turf & Landscape, Inc. Ms. Fitch advised the Board that this matter was removed from the agenda. Wells Construction Commercial Development, Inc. (CL.34788) Administrative Hearing Consider an alleged violation by Wells Construction Commercial Development, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Civil District Court, No. 08-6942, Division L, Parish of Orleans, State of Louisiana, on the 21st day of November, 2008, in which Wells Construction Commercial Development, Inc., holder of Commercial Contractors License number 34788, pursuant to the Award of Arbitrator dated March 28, 2008 and the Disposition for Application of Modification of Award dated May 1, 2008, was ordered to pay in the amount of FORTY-THREE THOUSAND TWO HUNDRED THIRTY DOLLARS AND TWENTY-FOUR CENTS ($43,230.24) to be paid on or before (30) days from March 28, 2008 with post-judgment interest at the rate of 8.5% per annum commencing 30 days from March 28, 2008 in favor of David L. Schneider, M.D., A.P.M.C Ms. Fitch read the allegations and asked if a representative was present. Ms. Laborde disclosed to the Board that an attorney in her firms New Orleans office represented David L. Schneider, M.D., but felt there was no conflict as he was the Judgment Creditor and not the Judgment Debtor. Ms. Helen Schneider appeared on behalf of her husband, Dr. David Schneider. Ms. Schneider stated that as of this date no funds had been received towards the Judgment in this matter and asked that the Board revoke the License of WELLS CONSTRUCTION COMMERCIAL DEVELOPMENT, INC. A Motion was made by Mr. Meredith and seconded by Mr. Jones to give WELLS CONSTRUCTION COMMERCIAL DEVELOPMENT, INC. thirty (30) days to satisfy the Judgment or License number 34788 would be immediately revoked. The Motion passed. The Judgment in this matter was made part of the record. Compliance HearingS: Hoover Management Realty Team, Inc. Administrative Hearing Consider an alleged violation by Hoover Management Realty Team, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Hoover Management Realty Team, Inc. acted as a contractor to perform work on the Circle 1000 Condos project at 1000 St. Charles Street in New Orleans, Louisiana, in the amount of $314,104.00 without possessing a Louisiana State contractors license. Ms. Bobbie Hughes read the allegations against HOOVER MANAGEMENT REALTY TEAM, INC., and asked if a representative was present. Sean Hoover, Owner, HOOVER MANAGEMENT REALTY TEAM, INC., was present, came to the stand and was sworn in. Mr. Hoover denied the allegations. Ms. Catherine Davidson, General Counsel for the Circle One Thousand Condominium Association was also present. Ms. Davidson stated that she was present on behalf of the Association. Ms. Davidson informed the Board that her organization did not file the complaint against Mr. Hoover but does employ Mr. Hoover. Ms. Davidson also informed the Board of Mr. Hoovers duties as an employee of Circle One Thousand Condominium Association. Ms. Laborde called Compliance Investigator Lynwood Allemore to the stand, and he was sworn in. Ms. Laborde reviewed the exhibit packet with Mr. Allemore, which was entered into the record. Mr. Hoover informed the Board that one of the Exhibits, the Association Minutes from the November 2, 2009 meeting, were incomplete. Mr. Hoover asked that the second page of the Minutes, and the original contract with between PSI and the Circle One Thousand Condominium Association, be introduced. Judge White admitted these documents. Mr. Keith Bourgeois, an owner of one of the condominiums and a licensed contractor since 1996, was also present. Mr. Bourgeois was sworn in, and informed the Board that he feels Mr. Hoover is acting in the capacity of a General Contractor without possessing a license. The Board recommended that Mr. Hoover obtain a License if he was going to continue to act in his current capacity. A Motion was made by Mr. Stuart and seconded by Mr. Clouatre to dismiss the allegations against HOOVER MANAGEMENT REALTY TEAM, INC. The Motion passed. Cobra Electric, Inc. Administrative Hearing Consider an alleged violation by Cobra Electric, Inc. of the provisions of Louisiana R.S. 37:2158 (A,5) of the State of Louisiana Contractors Licensing Law, in that you have permitted your contractors license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, at  FORMTEXT AT & T Remodel (Cortana Place),  FORMTEXT Baton Rouge, Louisiana. Ms. Bobbie Hughes read the allegations against COBRA ELECTRIC, INC., then asked if a representative was present. No representative was present. Ms. Laborde called Compliance Investigator Todd Brady to the stand and he was sworn in. Ms. Laborde reviewed the exhibit packet with Mr. Brady, and Judge White accepted the exhibit packet into the record. Ms. Laborde informed the Board that she was advised that COBRA ELECTRIC, INC. was going out of business and was planning to turning in its license. Ms. Laborde stated that, to her knowledge, that had not yet been done. A MOTION was made by Mr. Meredith and seconded by Mr. Lambert to find COBRA ELECTRIC, INC. guilty. The Motion passed. A MOTION was made by Mr. Meredith and seconded by Mr. Lambert to assess COBRA ELECTRIC, INC. a fine of $1000.00 plus Administrative Fees, and a one year probation. The Motion passed. Ms. Laborde informed the Board that she just was informed that COBRA ELECTRIC, INC. had appeared in the Board Office this morning and turned in its license. Ms. Laborde asked that the Board accept the tendering of COBRA ELECTRICs license in lieu of the one year probation. A Motion was made by Mr. Lambert and was seconded by Mr. Gallo to accept the License of COBRA ELECTRIC, INC. The Motion passed. Construction Corporation of South Louisiana, Incorporated Administrative Hearing Consider an alleged violation by Construction Corporation of South Louisiana, Incorporated of the provisions of Louisiana R. S. 37:2150-2192, the Contractors Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Construction Corporation of South Louisiana, Incorporated, acted as a contractor to perform work on the Live Oak Manor Elementary School project in Westwego, Louisiana in the amount of $159,082.84 without possessing a Louisiana state contractors license. Ms. Bobbie Hughes read the allegations against Construction Corporation of South Louisiana, Incorporated, then asked if a representative was present. No representative was present. Ms. Laborde called Compliance Investigator Lynwood Allemore to the stand, and he was sworn in. Mr. Allemore noted for the record that the school project was actually in Gretna, not Westwego. Ms. Laborde reviewed the exhibit packet with Mr. Allemore and Judge White accepted the exhibit packet into the record. A MOTION was made by Mr. Lambert and seconded by Mr. Gallo to find Construction Corporation of South Louisiana, Incorporated guilty. The Motion passed. A MOTION was made by Mr. Lambert and seconded by Mr. Gallo and Mr. Graham to assess Construction Corporation of South Louisiana, Incorporated a fine of $2000.00 plus administrative costs. The Motion passed. Northgate Land Development Corp. Administrative Hearing Consider an alleged violation by Northgate Land Development Corp. of the provisions of Louisiana R.S. 37:2150-2192 and in particular Section 2159 Paragraph B, of the State of Louisiana Contractors Licensing Law and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Northgate Land Development Corp., after classification bid and/or contracted to perform a type of work that was not included under the classification which their license was issued, on the Magnolia Springs Subdivision project located in St. Gabriel, Louisiana. Ms. Bobbie Hughes read the allegations against Northgate Land Development Corp., then asked if a representative was present. Chris Pierce, Attorney, appeared on behalf of Northgate Land Development Corp. Mr. Pierce informed the Board that his clients had taken the test to obtain the proper license required and will have to retake a portion of that test. Mr. Laborde informed the Board that a settlement offer had been made which was neither recommended nor rejected by staff, and asked Mr. Pierce to make that offer to the Board directly. Mr. Pierce stated that he wished to enter a plea of No Contest, to pay a One Thousand Dollar fine and to continue to try to obtain the required licenses. A Motion was made by Mr. Lambert and seconded by Mr. Stuart to accept the settlement offer made by Mr. Pierce on behalf of Northgate Land Development Corp. The Motion passed. COMPLIANCE HEARINGS SETTLEMENT OFFERS: Pro Line Panel Systems Administrative Hearing Consider an alleged violation by Pro Line Panel Systems of the provisions of Louisiana R. S. 37:2150-2192, the Contractors Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Pro Line Panel Systems, acted as a contractor to perform work on the Harvey Toyota Addition project in Bossier City, Louisiana in the amount of $121,500.00 without possessing a Louisiana state contractors license. Ms. Hughes read the allegations against PRO LINE PANEL SYSTEMS. Ms. Hughes informed the Board that a settlement offer had been made which included a plea of No Contest, a $500 fine, with an additional $500 to cover administrative costs. A Motion was made by Mr. Gallo and was seconded by Mr. Fenet to accept the offer. The Motion passed. Bonomo Builders, Inc. Administrative Hearing Consider an alleged violation by Bonomo Builders, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Bonomo Builders Inc., entered into a contract with an unlicensed contractor to perform work on the Harvey Toyota Addition project in Bossier City, Louisiana in an amount in excess of $50,000.00. Ms. Hughes read the allegations against BONOMO BUILDERS, INC. Ms. Hughes informed the Board that a settlement offer had been made which included admitting the allegations, and $500 to cover administrative costs. A Motion was made by Mr. Lambert and was seconded by Mr. Fenet to accept the offer. The Motion Passed. Racetrac Petroleum, Inc. Administrative Hearing - Consider an alleged violation by Racetrac Petroleum, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Racetrac Petroleum, Inc. acted as a contractor to perform work on the Racetrac Gas Stations projects at Siegen Lane and Old Hammond Highway in Baton Rouge, Louisiana, and Highway 30 in Gonzales, Louisiana, in an amount in excess of $50,000 without possessing a Louisiana State contractors license. Ms. Bobbie Hughes read the allegations against RACETRAC PETROLEUM, INC., and informed the Board that Ms. Laborde would be presenting a settlement offer. Ms. Laborde informed the board that RACETRAC PETROLEUM, INC. requested that all three of its ongoing projects be covered by the proposed settlement. Ms. Laborde summarized the terms of the proposed settlement. Ms. Laborde noted that the settlement letter received from RACETRAC PETROLEUM, INC. would be entered into the record. Mr. Justin Ourso, Attorney, appeared on behalf of RACETRAC PETROLEUM, INC. Mr. Ourso asked the Board to consider dismissing the allegations against his client before accepting the offer presented. Humphreys General Contractor, Inc. of the provisions of Louisiana R.S. 37: 2158 (A) of the State of Louisiana Contractors Licensing Law, and in particular Paragraph 9 and consideration of applicable penalties therein. This hearing is being called for reason that, on information and belief, C.R. Humphreys General Contractor, Inc, has had problems relating to the ability of the contractor, its qualifying party, or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience, at but not limited to the Cajun Country Inn project located in Gonzales, Louisiana. Ms. Bobbie Hughes read the allegations against C.R. HUMPHREYS GENERAL CONTRACTOR, INC. and asked if there were any representatives present. Ms. Laborde informed the Board that this matter was a continuation of a Hearing that was previously held by the Board, and evidence and testimony introduced at that Hearing is before the Board today. Mr. Badeaux asked Ms. Laborde to remind the Board of this matter. Kevin Landreneau, Attorney, appeared on behalf of C.R. HUMPHREYS GENERAL CONTRACTOR, INC. Ms. Laborde gave a synopsis of this matter. At the conclusion of the last Hearing, Mr. Meredith wanted additional information regarding subcontractors. Mr. Meredith stated that previously the Board heard from people but no subcontractors and, if the Board was going to decide anything, he wanted to speak to the subcontractors to address the question of his ability as a general contractor. Ms. Laborde presented statements from the subcontractors. Mr. Landreneau stated that they had subcontractors present that would attest that Mr. Humphreys is able to act as a general contractor. Ms. Laborde stated that she only had statements from subcontractors. Mr. Landreneau objected to the submission of the statements as they are hearsay. Mr. Lambert stated that the disputes between the contractor and the subcontractors were really a matter for the Court, and that the Board cannot get involved until there is a Judgment in place that can be enforced. Mr. Lambert moved to dismiss the charges before the Board, which, was seconded by Mr. Graham. The Motion passed.
