Issues generally include the who, what, where, when, and why of the incident prompting the investigation. For example, the basic issues of an alleged incident of wrongdoing would include: 1. What occurred? 2. When, where, and how did it occur? 3. Why did the event occur? 4. Was it appropriate for the event to occur in these circumstances? 5. Should the subject have known not to take, or to take, the action under question? Issues may be identified in the authorization letter. However, during the course of the investigation some issues may be resolved while new ones arise. Identify issues based on the allegations, known evidence, etc. Certain issues common to most investigations: The nature and sequence of significant events - Did the event occur? If so, when, where, and how? Who was involved in the event? Did an event fail to occur that should have? Preparing Verbatim Transcripts If verbatim transcripts are desired, they can be prepared by court reporting services or by support staff. Transcripts may be prepared in any standard deposition format. Regional Counsel can provide samples. If practicable, ask the court reporter to index the transcript. For a minimal additional cost, an index will greatly simplify finding specific testimony for AIB members and users of the report. Upon receipt of the transcript, provide a copy of the individual testimony have the witness review the transcript. List any necessary corrections of transcription errors on an attached sheet (not on the transcript)/ Provide a separate signed and dated statement, if needed to correct any misstatements or to provide important clarifying information if necessary. Attach any statement or corrections page to the transcript; Have the witness sign the transcript and return it to you for inclusion in the investigative file. If the witness refuses to sign, ascertain the witnesss reasons, and summarize the reasons for refusal in the report of investigation. Findings of Facts Worksheet Findings of Fact are factual statements relevant to the issues investigated that have been determined to be true. Findings of fact shall be specific with respect to times, places, persons, and events. A finding of fact must be: 1) supported by evidence objectively establishing its truth; 2) not substantially contradicted by other evidence; and 3) does not require inferences or other interpretations that may reasonably be disputed. NOTE: Determinations that do not meet all of these criteria shall be listed as conclusions. Conclusions must be supported by a preponderance of the evidence (i.e. more likely true than not true). Conclusions shall be stated clearly, followed by a concise statement of the basis for the conclusion, including the facts, evidence, policies, regulations, standards, etc., upon which the conclusion is based. Any evidence that materially conflicts with a conclusion of the AIB must also be specifically identified and the resolution of the conflict shall be discussed. Sample Conclusion:  Statement of basis for conclusion: Identification of conflicting evidence and resolution: Example: Employee Smith was disrespectful to Veteran P.A. on June 1, 2003, when he told Veteran P.A. in a loud and serious tone of voice I dont have time for this nonsense.  Both the Veteran and Employee Jones provided consistent sworn testimony in support of this. Employee Brown testified she overheard only the tone of employee Smiths words, and the tone reflected a joking manner of speaking. However, Ms. Brown only heard the first part of the interaction between Mr. Smith and Veteran P.A. and did not here the portion witnessed by employee Jones.  Conclusion Worksheet: Conclusion:  Statement of basis for conclusion: Identification of conflicting evidence and resolution:      Writing the Report Reminders Remember your audience may include individuals unfamiliar to functions, terminology, and organizations. Explain references, terminology, and acronyms as needed. Identify the specific evidence relied upon for each finding of fact. Ensure that all evidence relied upon is contained and referenced as an exhibit in the report and file. Where appropriate, use official titles rather than personal names. Clearly identify each conclusion and address (in the analysis section) why you believe it to be true. Identify how you resolved significant inconsistencies or conflicts in evidence with an objective analysis. Provide Recommendations only if required or permitted in the authorization letter. Ensure any recommendations are well supported by your findings and conclusions. Writing the Report Worksheet NOTE: This worksheet is provided solely for the purpose of planning the report and can be used to take notes and identify the general content of the report that will need to be addressed in greater detail in the final report. REPORT OUTLINE I. Preliminary Statement a. Identify the authority for conducting investigation. b. Identify the scope of the investigation. c. List or summarize the witnesses interviewed. e. Identify important relevant material contained in the report. d. Discuss any significant problems or procedural matters. II. Findings of Fact a. Factual statements relevant to the issues investigated. b. Be specific with respect to times, places, persons, and events. c. Identify the exhibits containing evidence supporting the finding. d. References to transcripts or large exhibits must include page numbers. III. Conclusions a. Determinations, other than findings of fact, that are supported by a preponderance of evidence. b. These include interpretation of evidence, resolution of conflicting evidence, credibility assessments, application of technical standards. c. State the conclusion followed by a concise statement of the basis for the conclusion, including the facts or evidence upon which the conclusion is based. d. Conclusions should resolve disputed facts material to the issues. IV. Signature a. Each member shall sign unless impracticable to do so. b. Include a statement as to why a member did not sign. c. Signatures reflect the accuracy of the report and view of a majority of members. V. Exhibits a. Any material referred to or considered in the findings of fact or conclusions. b. An index of all exhibits shall be prepared identifying each by number, description, and source. OPTIONAL REPORT COMPONENTS Executive Summary The AIB may summarize the investigations scope, issues, findings, and conclusions in an executive summary, which should be formatted as a transmittal letter for the investigation report. Such a summary is particularly helpful for investigations with complex findings or conclusions. Executive summaries do not constitute the findings or conclusions of the AIB. Recommendations (only include if specifically authorized by convening authority) - Must be firmly based on evidence, findings of fact, and conclusions. Must state clearly the evidence, findings of fact, or conclusion on which they are based. Must be stated in terms such that they can be implemented directly by the convening authority. May recommend appropriate corrective action and the specific misconduct for which corrective action is deemed appropriate. Do not recommend a specific level of discipline. Separate Opinions Any member who disagrees with a material part of the report should prepare and attach a signed separate opinion identifying those matters with which he or she disagrees, the specific reasons therefore, and any evidence relied upon. Explanatory Material The AIB should consider including helpful diagrams and charts, organization charts, and witness identification list with the report. These materials should be included as exhibits if they are used as evidence, but should be included as attachments otherwise. Important Correspondence Important correspondence about the investigation, such as objections by witnesses or their representatives or coordinating letters regarding investigations, should be included as attachments.
