Dear Resident:

Grace Management and Subdivision Services are pleased to have been hired by your Board of Directors to manage Maple Creek Plantation Association. Our Management Team offers specialized management services for Homeowner’s Associations. We work closely with your Board of Directors to ensure the highest standards for your community. We are available to all residents to answer any questions and/or concerns and look forward to working with you.

You may have chosen to live in a community with protective covenants because of the amenities, the beautiful environment or to enhance the value of your property. Regardless of the reason, we believe your decision was a wise one and we will make every effort to provide you with the best service possible.

Grace Management supports the Board of Directors by providing all of the financial services of the community including collection of assessments, payment for services and production of monthly financial statements. We also help organize annual meetings (i.e. securing a location, mailing out required notices).

Grace Management Services may also provide assistance with vendor selection including landscape companies, insurance agents, etc. We are available to all residents to answer any questions regarding their account or other association matters..

Subdivision Services, Inc. provides a service to consistently and fairly enforce the Protective Covenants established for Maple Creek Plantation. In addition, we are responsible for overseeing the landscaping services and other maintenance contracts as directed by your Board of Directors.

We perform a weekly drive thru reviewing properties and noting any covenant violations. We ensure all proper notification is sent to the homeowner in violation and follow up with the Board of Directors for resolution (i.e. assess a fine and/or enter the property and make all necessary corrections).

The goal is to help homeowners be responsible for their own property and help maintain high property values for all in the community. We are available to all residents to answer any questions regarding the Covenants and/or common area maintenance or to report a violation.

Covenants at a Glance

Architectural Review

Article V Section 6

No structure shall be commenced, erected, placed, moved onto or permitted to remain on any Lot nor shall any existing structure upon any Lot be altered, including painted or stained, in any way which materially changes the exterior appearance of the structure or the Lot, unless plans and specifications therefore shall have been submitted to and approved in writing by the Architectural Control Committee. Maintenance

Article VI Section 2

Each Owner shall keep and maintain each Lot, the exterior of the dwelling and all structures owned by him, as well as all landscaping located thereon, in good condition and repair including, but not limited to:

• Repairing and painting for the dwelling and all other structures

• Seeding, fertilizing and watering of all lawns and mowing, edging, clipping, sweeping, pruning, raking and otherwise caring for all lawns

• Pruning and trimming of all trees, hedges and shrubbery not maintained by the Association

• Maintenance, repair and painting of all fences on the Lot

Signs

Article VI Section 5

No sign of any kind shall be erected by an Owner or Occupant of a Lot except for one “For Sale” and “For Rent” sign.

Vehicles

Article VI Section 6

All vehicles shall be parked within garages, driveways or other paved parking areas located on a Lot.

Parking in yards or on streets within the development is prohibited. Lot owners’ visitors may temporarily park on the street.

No inoperable, junk or abandoned cars or equipment of any description shall be parked or stored on any portion of the property.

In no event may any vehicle having a gross weight of more than 8500 pounds be parked on any of the Lots or common property in the development, or in any streets or roads in the development, without the prior written approval of the Declarant; provided; however that this provision shall not be applicable to construction vehicles being used by the Declarant, or by a builder approved by the Declarant.

Recreational Vehicle and Trailers

Article VI Section 7

No school bus, truck or commercial vehicle over one (1) ton capacity, house trailer, mobile home, motor home, recreational vehicle, or like equipment shall be permitted on any Lot or Common Property on a permanent basis, but shall be allowed on a temporary basis not to exceed three consecutive (3) days.

Boats, trailers, motor homes, recreational vehicles and campers shall be permitted but only if stored inside the garage or in the rear of each unit and is concealed from view of neighboring residences and streets, and only after obtaining written consent of the ACC.

No above ground swimming pools will be allowed and trampolines shall not be visible from the street.

Any trash, firewood, wood scraps, building materials or other such materials contained in any vehicle or trailer shall be covered from view.

No Exposed Concrete/Concrete Blocks

Article VI Section 9

There shall be no exposed concrete or concrete blocks and foundation or other walls of buildings. Such surfaces shall be veneered with brick or natural stone, stucco, or painted where they are above finished grade.

Garages

Article VI Section 11

All garages are to be enclosed with doors.

Animals and Pets

Article VI Section 12

No animals, livestock or poultry of any kind may be raised, bred, kept or permitted on any Lot or Common Property, with the exception of dogs, cats or other usual and common household pets in reasonable number. No pets shall be kept, bred, or maintained for any commercial purpose. Dogs which are household pets shall at all times, when outside, be on a leash or within an allowable fence,. In addition, no “outside” pets shall be permitted on any Lot at any time without the written permission of the Declarant (“outside” pets shall be any pet which remains outside the house for more than two hours per day on regular basis).

Fences and Outbuildings

Article VI Section 13

No fence, wall or outbuilding of any kind shall be erected, maintained or altered on any Lot without the prior written approval of the Delcarant or the approval of the ACC of plans and specifications for such fences and walls. Design standards for fences must be approved by the Delcarant or ACC.

Fence guidelines:

No fencing of any type shall be placed closer to the street than the rear corner wall of the dwelling unless approved differently by the ACC.

Wooden privacy fences shall be allowed in areas visible from the street. Black chain link fence shall be allowed in areas not visible from the street and behind the dwelling. No chain link fences allowed on corner Lots.

Retaining Walls:

Retaining walls which attach to the residence should be finished with the same material as the walls with which they are in contact with on the dwelling, or such other materials as the Declarant or ACC may approve. Cross-tie walls may used if set apart from the house.

Shed, Tool or Storage Area

No shed, tool or storage area, workshop or outbuilding for storage of yard implements shall be placed upon the property unless approved by the ACC. No shed, tool storage area, workshop or outbuilding shall be constructed in the same architectural style using similar colors and material as the main dwelling on the Lot.

Garbage Cans, Woodpiles, Etc.

Article VI Section 16

All garbage cans, woodpiles, or conditioning compressors, heat pumps, swimming pool pumps, swimming pool filters, swimming pool heaters and related equipment and other items shall be located or screened so as to be concealed from view of neighboring streets and property. No Lot or Common Property shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be regularly removed from the property and shall not be allowed to accumulate in an unsightly quantity and shall be kept in sanitary containers. No trash or garbage or other rubbish shall be placed at the street or curb for pickup for the sanitation company providing service to the Development earlier than 9:00pm on the day immediately preceding the sanitation company’s scheduled day for pickup.

The pursuit of hobbies or other activities, including specifically, without limiting the generality of the foregoing, the maintenance, assembly or disassembly of motor vehicles or other mechanical devices, which might tend to cause disorderly, unsightly, or unkept conditions shall not be allowed, pursued or undertaken on any Lot.

No trash, garbage, rubbish or waste of any kind shall be buried or burned on the property without the written consent of the Declarant.

Firearms

Article VI Section 17

The discharge of firearms in the Development is prohibited. The term “firearms” includes B-B guns, pellet guns, paintball guns, and guns of all types.

Mailboxes

Article VI Section 18

All mailboxes and stands shall be approved by Declarant. All mailboxes and stands shall be maintained in a good state of repair.

Monuments, Statues, Birdbaths, Etc.

Article VI Section 19

No monuments, statues, birdbaths or decorative structures shall be erected or placed in the front of any dwelling without the written consent of the ACC.

Window Treatment

Article VI Section 20

No foil or other reflective materials shall be used on any windows for sunscreens, blinds, shades or for any other purpose. No temporary window treatments such as blankets, sheets or towels are permitted at any time.

Nuisance

Article VI Section 21

It shall be the responsibility of each Owner and Occupant to prevent the development of any unclean, unhealthy, unsightly, or unkempt condition on his or her property. No property within the development shall be used, in whole or in part, for the storage of any property or thing that will cause such Lot to appear to be in an unclean or untidy condition or that will be obnoxious to the eye; nor shall any substance, thing, or material be kept that will emit foul or obnoxious odors or that will cause any noise or other condition that will or might disrupt the peace, quiet, safety, comfort or serenity of the occupants of surrounding property. No noxious or offensive activity shall be carried on within the Development, nor shall anything be done tending to cause embarrassment, discomfort, annoyance or nuisance to any person using any property within the community. Without limiting the generality of the foregoing, no speaker, horn, whistle, siren, bell, amplifier or other sound device shall be used except those devices exclusively for security purposes or required by law.

Subdivision Services Enforcement Process

● A Violation can be reported by the Homeowners or observed by Subdivision Services.

● Once a violation is identified, Subdivision Services will go through the following process: (subject to change with direction from the Board of Directors)

Friendly letter will be mailed:

This letter is mailed to the homeowner by first class mail. It is sent to make the homeowner aware that their home/property is in violation of the Protective Covenants and Restrictions and/or Rules and Regulations set forth by the Board of Directors. The homeowner has seven (7) days to correct the violation or to contact Subdivision Services with their intentions.

Certified letter will be mailed:

This letter is mailed both first class and certified mail to the homeowner if the violation is not corrected within the seven days. It again states the violation and gives the homeowner ten (10) days for the violation to be corrected. If the violation is not corrected within ten (10) days, the Board has the right to take further action which may include: entering the property and making all necessary and reasonable corrections.
