SAMPLE REALTOR/LENDER AGREEMENT*

This Joint Marketing Agreement is entered into on (date) ______________, 20__ by NAME OF LOAN EXECUTIVE hereafter named as Lender, and REAL ESTATE AGENT hereafter named as Agent.

1. Lender will provide Agent with a means to capture the phone numbers of potential homebuyers via the 24-hour Call Capture system. By dialing the toll-free number provided on signage and advertising, the caller will hear a recorded message that lists the amenities and finance options for the property, based on the Joint Marketing Agreement.

2. Lender may choose to advertise Agent’s Listing(s).

3. Lender agrees to follow up on all leads for the purposes of pre-qualifying and/or pre-approving the potential home buyer.

4. Lender agrees to refer the prospect(s) to Agent, providing the Agent continues to meet our agreed-upon standards of quality customer service and provided the prospect has not already selected another Realtor® they prefer to work with.

5. Agent agrees to include assigned Call Capture 800 number in all of their print advertising, online listings, and signage whenever possible.

6. Weekly progress reports via [Fax/Phone] will be [Submitted/Held] each [Day] at [Time] by both Lender and Agent.

7. Lender and Agent agree to work cohesively as a team to ensure quality customer service.

9. This Joint Marketing Agreement can be cancelled in writing by either party within 30 days; by mutual agreement; or rendered null and void by any Act of God or any other condition beyond the control and without the fault of either Lender or Agent, in which event all parties are released from any liability or damages hereunder.

10. This Joint Marketing Agreement shall be binding upon Lender and Agent and their respective successors and assigns, and shall be deemed to be made in, and in all respects shall be interpreted, construed and governed by and in accordance with, the internal laws of the State of NAME OF STATE.
