The regular monthly meeting of the Board was called to order by the Chairman at 9:45 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Mr. August Gallo, Jr., Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.

Resolution of the Board of the Louisiana State Licensing
Board for Contractors
Whereas the Louisiana Legislature, by Act Number 725, did amend and reenact R.S. 37:2156.1 (F) and did enact R.S. 37:21501.1 (14) and (15) and 2156.1 (M), relative to the licensing of electrical and mechanical contractors, to provide for definitions; to provide for preemption of certain contractors; to provide for waiver of examination under certain circumstances; and to provide for related matters; and
Whereas, it was further enacted by the Louisiana Legislature to amend and reenact Section 1. R.S. 37:2156 (F) and R.S. 37:2150.1 (14) and (15) and 2156.1 (M); and
Whereas, the Louisiana State Licensing Board for Contractors (THE BOARD) did set up testing, reviewing documents and other actions to create the opportunity for Mechanical Contractors as defined in Chapter (15) and Electrical Contractors as defined in Chapter (14) and to enable these Contractors to obtain licensure as provided by Act 725; and
Whereas, (THE BOARD) did further advertise, pass out brochures, conduct meetings, inform Trade Organizations and various Parish officials and did further make announcements of the availability for the Mechanical and Electrical Contractor to apply for licensure provided under Act 725; and
Whereas, (THE BOARD) did further install a 725 Committee to review all applications from the Mechanical, Plumbing and Electrical Contractors that did apply and did provide certain testing materials and finally the 725 Committee did commit licensing to whatever parish of the State of Louisiana these Mechanical, Plumbing and Electrical Contractors did prove; by authentic copies of contracts, permit applications or held a license prior to July 1, 2008 by a local municipalities and did waive the examination required and did grant no more than licensure in three (3) parishes or municipalities; and
Whereas, (THE BOARD) does hereby resolve and does hereby acknowledge the intent of Act 725 to enforce the act whereby all municipalities and or parishes are now obligated to issue a Mechanical, Plumbing or Electrical license to any of these Contractors that have presented to such parish or municipality their License issue from this BOARD and the parish and municipalities will thereby waive any and all testing requirements to the limit of either (1) (2) or (3) parishes/ municipalities where these Contractor may have given proof of work as required by Act 725.
Thus done and resolved, pursuant to a resolution of the members of the Board of the State of Louisiana Licensing Board for Contractors, duly made and seconded at the meeting of the Board held on the 20th day of May, 2010.
A MOTION was made by Mr. Gallo and seconded by Mr. Meredith to approve and adopt this Resolution.

Resolution of the Board of the Louisiana State Licensing
Board for Contractors
Whereas the Louisiana Legislature, by Acts 1995, No. 751, § 1, Amended by Acts 2001, No. 612, § 1, has authorized the Louisiana Department of Social Services Office of Family Support to certify to the Board that a licensee is not in compliance with a judgment or order for the support of dependent children issued by any court of this state or another state; and
Whereas the Legislature has directed by the same Acts that the Board, upon receipt of such a certification of noncompliance, must within thirty days suspend the license of the licensee named therein and notify the licensee that his license has been suspended because of noncompliance with an order of support; and
Whereas, the Legislature did further direct by the same Acts that a license suspended under these circumstances may not be reissued until the Department of Social Services Office of Family Support does certify to the Board that the licensee has come into compliance with the order of support, by means of a compliance release certificate; and
Whereas, after receipt of the compliance release certificate, the Board may issue, reissue, renew, or otherwise extend the license, in accordance with any applicable reinstatement fees or applicable rules; and
Whereas the Board does desire to cooperate with the Department of Social Services and does further recognize its obligation to comply with the directives of the Legislature, set out in the specified Acts;
Be it therefore resolved that the Executive Director of this Board, upon receipt of a certification of noncompliance with an order of support from the Louisiana Department of Social Services Office of Family Support, is authorized and directed to:
(1) confer with the Department of Social Services Office of Family Support and if deemed necessary in his discretion review the record of the administrative proceeding held by the Department of Social Services Office of Family Support to determine that the licensee is in fact the same person identified in the certificate of noncompliance with an order of support;
(2) upon confirming that the licensee is the person found by the Department of Social Services Office of Family Support to be not in compliance with an order of support, suspend the license of the licensee and provide such notice of the suspension to the licensee as is required by the Acts referenced above, such suspension to remain in effect until the Board does receive from the Department of Social Services Office of Family Support a compliance release certificate.
Thus done and resolved, pursuant to a resolution of the members of the Board of the State of Louisiana Licensing Board for Contractors, duly made and seconded, at the meeting of the Board held on the 20th day of May, 2010.

A MOTION was made by Mr. Lambert and seconded by Mr. Stuart to accept the Minutes of the April 15, 2010 regular board meeting, as typed. The motion passed.
NEW BUSINESS:
◙ Judgment Hearing(s):
Alley Square Construction, L.L.C. (CL#45710)
Administrative Hearing – Consider an alleged violation by Alley Square Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 21st Judicial District Court, No. 2009-1305, Division “B”, Parish of Tangipahoa, State of Louisiana, on the 18th day of December, 2009, in which TLS Louisiana, L.L.C., Alley Square I, L.L.C. and Alley
Square Construction, L.L.C., holder of commercial contractor’s license number 45710, were ordered to pay jointly, severally, and in solido, in the principal amount of FIFTEEN THOUSAND DOLLARS AND NO/100, ($15,000.00), with interest at the annual rate of 12% from the date of this judgment until paid and all costs of court in favor of Stock Building Supply, Inc.
Ms. Kris Fitch read the allegations against ALLEY SQUARE CONSTRUCTION, L.L.C. then Judge White asked if a representative of ALLEY SQUARE CONSTRUCTION, L.L.C. was present. Mrs. Nita Gorrell, Attorney representing Alley Square Construction, LLC and Mr. Frank White, Attorney representing Stock Building Supply were both present.
Attorney Gorrell came to the stand, stated that her client was pleading No Contest that her client is working to pay this judgment off.
Attorney White also came to the stand.
Board Attorney, Trippe Hawthorne asked Attorney White if payments are being made and does he have a specific request to make to the Board.
Attorney White responded for clarification these are debts that go back late to 2008. A suite was filed in 2009 then right before the trial in November, 2009 they were contacted about paying the debt. They were asked to reduce the amount that was due, waive their attorney fees and waive court costs and in ninety (90) days they would pay them $15,000.00. Ninety (90) days went by Alley Square did not pay the $15,000.00. Attorney White attempted to contact the debtor, no phone calls returned, no responses received from his letters they filed a complaint with this Board then last month for the first time they received a $1,500.00 check. There is been no attempt to comply until the Board became involved. They are willing to work with people, same desire this time but he wants to make it clear that there has been no attempt to do this. . . .
Board Chairman, Mr. Talbot asked Attorney White if he would accept $1,500.00 a month, would they accept it.
Attorney White responded he would have to speak with his client. He said that offer was made to him for the first time this morning before this meeting. They would asked the Board to issue a sixty (60) day order and during that time they will try to resolve the matter.
Mr. Weston responded let’s give Alley Square sixty (60) days to work this out, on a pay schedule. Then if the pay schedule is not acceptable to Attorney White’s client, the Board would do an immediate revocation of Commercial License Number 45710 held by Alley Square Construction, L.L.C. at the end of sixty (60) days. This is not a dragged out issue, this is a gift of sixty (60) days.
A MOTION was made by Mr. Weston and seconded by Mr. Dupuy and Mr. Jones to give Alley Square Construction, L.L.C. sixty (60) days to resolve this matter on a payment schedule. At the end of the sixty (60) days if not resolve commercial license number 45710 held by ALLEY SQUARE CONSTRUCTION, L.L.C. will immediately be revoked. The motion passed.
Cobra Electric, Inc. (CL#41650)
Administrative Hearing – Consider an alleged violation by Cobra Electric, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 21st Judicial District Court, No. 127128, Division “F”, Parish of Livingston, State of Louisiana, on the 25th day of March, 2010, in which Cobra Electric, holder of commercial contractor’s license number 41650, was ordered to pay in the full sum of ONE THOUSAND THREE-HUNDRED NINE DOLLARS AND 29/100, ($1,309.29) together with legal interest from the date of judicial demand until paid, reasonable attorney’s fees in the amount of $1,028.75, as well all court costs and
expenses incurred in connection with these proceedings, the execution of this judgment, and for all other equitable relief provide by law in favor of Austin Fire Equipment, LLC.
Ms. Kris Fitch read the allegations against COBRA ELECTRIC, INC. then Judge White asked if a representative of COBRA ELECTRIC, INC. was present. Mr. Billy Sanders and Mr. Ronald Miller representing Cobra Electric and Mrs. April Broussard, Attorney representing Austin Fire Equipment were all present.
Mr. Sanders and Mr. Miller both came to the stand, they were sworn in.
Board Attorney, Trippe Hawthorne questioned Mr. Sanders and Mr. Miller about than unsatisfied judgment with Attorney Broussard’s client.
Mr. Miller responded there was a discrepancies about some late fee that were incurred on the project. They didn’t feel the owed the late fees, because they were late being paid by their General Contractor, they have reached an agreement with Austin Fire Equipment and have restitution and are just waiting for their check to clear the bank.
Attorney Broussard came to the stand and that once Cobra received notice of these proceedings her client had received a check in the amount of $2,765.00 which includes the principle amount of the judgment. Court costs and attorney fees were also awarded in that judgment. They were given the check on May 17th. So they have not received notice that this check has cleared the bank. They are obviously waiting on that. Her client has also requested in accordance with the judgment that they be granted attorney fees preparation and attendance at the hearing today, which are not included in these payments.
Board Chairman, Mr. Talbot asked Attorney Broussard if the amount is in here now.
Mr. Dupuy responded that the attorney fees she is requesting are not in the judgment.
Board Attorney, Trippe Hawthorne responded no – no.
Attorney Broussard responded the judgment awards attorney fees for all of their costs up to date of judgment and also for execution of judgment.
Board Attorney, Trippe Hawthorne responded to Attorney Broussard that the Board is not authorized to assess additional fines to that type of request. The Board could issue a fine, but that would not be payable to her.
A MOTION was made by Mr. Meredith and seconded by Mr. Lambert to give COBRA ELECTRIC, INC. thirty (30) days to satisfy the remaining amount of $1309.29 unpaid in the outstanding judgment. The motion passed.
Foster & Company General Contractors, Inc. (CL #46415-Inactive)
Administrative Hearing – Consider an alleged violation by Foster & Company General Contractors, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 19th Judicial District Court, No. 582,097, Section 27, Parish of East Baton Rouge, State of Louisiana, on the 3rd day of December, 2009, in which GAA Nicholson, LLC and Foster & Company General Contractors, Inc., holder of inactive commercial contractor’s license number 46415 (license can be renewed), were ordered to pay in solido, in the full sum of ONE HUNDRED NINE THOUSAND TWO DOLLARS AND 25/100, ($109,002.25), together with the costs of the filing of the lien and Statement of Claim and Privileges together with legal interest thereon from the date of judicial demand until paid and for reasonable attorney’s fees and costs.
IT WAS FURTHER ORDERED ADJUDGED AND DECREED that the lien filed on July 1, 2009 located at MOB 221 Page 12165 with the Clerk of Court and Recorder of Mortgages in and for East Baton Rouge Parish, Louisiana, by Angelo’s Lawn-Scape of Louisiana, Inc. against the property known as The Preserve at Longwood, Parish of East Baton Rouge with a municipal address as 11959 Nicholson Drive, Baton Rouge, Louisiana, be recognized as bearing against the following described property:
A certain tract or parcel of land together with all buildings and improvements thereon, and all rights, ways, privileges, and servitudes thereunto belonging or in anywise appertaining, situated in the Parish of East Baton Rouge, State of Louisiana, in Section 43, T-8-S, R-1-E, Greensburg Land District, East Baton Rouge Parish, Louisiana, and designated as TRACT A-ONE-B-TWO-A(A-1-B-2-A), containing 9.824 acres as shown on a map entitled, “ALTA/ACSM LAND TITLE SURVEY of Tract-A-1-B-2-A & Tract A-1-B-2-B, Verdie Reese Perkins et, al. Tract, located in Section 43, Township 8 South, Range 1 East, Greensburg Land District, East Baton Rouge Parish, Louisiana, for Courtland Partners”, said map made by David B. Fazckas, P.L.S. for Benchmark Group, LLC, dated November 20, 2006, a copy of which map is on file and of record in the office of the Clerk and Recorder for the Parish of East Baton Rouge, State of Louisiana; said tract more fully described as follows:
Commencing at the intersection of the east right of way line of Nicholson Drive and the south right of way line of Gardere Lane, being the Point of Beginning; Thence along the south right of way line of Gardere Lane, North 53 degrees 05 minutes 24 seconds East, 661.59 feet; Thence South 22 degrees 24 minutes 53 seconds East, 641.88 feet; Thence South 52 degrees 59 minutes 15 seconds West, 691.31 feet to the east right of way line of Nicholson Drive; Thence along the east right of way line of Nicholson Drive, North 22 degrees 23 minutes 48 seconds West, 502.6 feet; Thence North 11 degrees 37 minutes 11 seconds, 151.13 feet, to the Point of Beginning. TOGETHER WITH all rights in and to the fifteen (15) foot private sewer servitude that extends from Tract A-1-B-2-B across the easterly side of subject property as shown on the map hereinabove referred to.
Said property being subject to such servitudes and building setback lines as shown on said map. Said lien be recognized and said property be in due course seized and sold and the proceeds applied to the payment of the claim of Angelo’s Lawns-Scape of Louisiana, Inc. in preference of any and all other and for all costs of these proceedings in favor of Land-Scape of Louisiana, Inc.
Ms. Kris Fitch read the allegations against FOSTER & COMPANY GENERAL CONTRACTORS, INC. then Judge White asked if a representative of FOSTER & COMPANY GENERAL CONTRACTORS, INC. was present. There was no response.
Ms. Fitch stated they received a letter from Foster & Company they acknowledge receipt of our notice of hearing letter that we sent to them and are acknowledging the judgment with Angelo’s Lawns-Scape, but they are unable to met their obligations, so in other words they are saying they are not going to pay the judgment. They are in severe cash flow problems and they are going to relinguish their license but staff has not received that yet, but they say in this letter they will be relinguising their license will not be paying this judgment.
A MOTION was made by Mr. Weston and seconded by Mr. Dupuy and Mr. Meredith to revoke commercial license number 46415 held by FOSTER & COMPANY GENERAL CONTRACTORS, INC. The motion passed.
Yur Construction Company, Inc. (CL #43199 & RL #87289)
This matter was continued until next month.

A & N Electric, Inc. (of Arkansas) (CL #14896)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 14896 held by A & N Electric, Inc. (of Arkansas) for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against A & N ELECTRIC, INC. (OF ARKANSAS) then Judge White asked if a representative of A & N ELECTRIC, INC. (OF ARKANSAS) was present. There was no response.
Ms. Fitch stated that this matter was five (5) months passed due and two (2) letters were sent, but no service was received on both letters.
Staff is recommending revocation of their license.
A MOTION was made by Mr. Crain and seconded by Mr. Stuart to revoke commercial license number 14896 held by A & N ELECTRIC, INC. (OF ARKANSAS) for not having a current qualifying party in place. The motion passed.
Advantis Construction Company (CL #48148)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 48148 held by Advantis Construction Company for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against ADVANTIS CONSTRUCTION COMPANY then Judge White asked if a representative of ADVANTIS CONSTRUCTION COMPANY was present. There was no response.
Ms. Fitch stated that this matter was eleven (11) months passed due, that was one (1) letter sent, but no service was received on that letter.
Staff is recommending revocation of their license.
A MOTION was made by Mr. Crain and seconded by Mr. Graham to revoke commercial license number 48148 held by ADVANTIS CONSTRUCTION COMPANY for not having a current qualifying party in place. The motion passed.
HDR Design-Build, Inc. (CL #47388)
Administrative Hearing – Consider removing the classifications of Highway, Street and Bridge Construction and Heavy Construction from the Louisiana contractor’s license number 47388 held by HDR Design-Build, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against HDR DESIGN-BUILD, INC. then Judge White asked if a representative of HDR DESIGN-BUILD, INC. was present. There was no response.
Ms. Fitch stated that this matter was seven (7) months passed due. Staff received a letter from the company dated May 12, 2010 stating they have no problem with removing the Building Construction classification from their license.
Staff is recommending removal of the Building Construction classification from their license only.
A MOTION was made by Mr. Crain and seconded by Mr. Stuart to remove the Building Construction classification from commercial license number 47388 held by HDR DESIGN-BUILD, INC. The motion passed.
Masram Mechanical LP (CL #49095)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 49095 held by Masram Mechanical LP for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against MASRAM MECHANICAL LP then Judge White asked if a representative of MASRAM MECHANICAL LP was present. There was no response.
Ms. Fitch stated that this matter was five (5) months passed due, there has been two (2) letters that were sent, but no service was received on those letters.
Staff is recommending revocation of their license.
A MOTION was made by Mr. Crain and seconded by Mr. Gallo to revoke commercial license number 49095 held by MASRAM MECHANICAL LP for not having a current qualifying party in place. The motion passed.
Picke Construction Corporation (CL #88428)
Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 45733 held by Picke Construction Corporation and your residential contractor’s license number 88428, for reason, that on information and belief that the qualifying party for your firm has terminated employment with your firm, and that no other qualifying party has qualified, despite sixty (60) days elapsing, as required by Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against PICKE CONSTRUCTION CORPORATION then Judge White asked if a representative of PICKE CONSTRUCTION CORPORATION was present. There was no response.
Ms. Fitch stated that this matter was eleven (11) months passed due, there have been three (3) letters that were sent, but no service was received on those letters.
Staff is recommending revocation of their license.
A MOTION was made by Mr. Crain and seconded by Mr. Graham to revoke commercial license number 88428 held by PICKE CONSTRUCTION CORPORATION for not having a current qualifying party in place. The motion passed.
Quality Contract Services, Inc. of Texas (CL #37463)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 37463 held by Quality Contract Services, Inc. of Texas for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against QUALITY CONTRACT SERVICES, INC. OF TEXAS then Judge White asked if a representative of QUALITY CONTRACT SERVICES, INC. OF TEXAS was present. There was no response.
Ms. Fitch stated that this matter was six (6) months passed due, there have been two (2) letters that were sent, but no service was received on those letters.
Staff is recommending revocation of their license.
A MOTION was made by Mr. Crain and seconded by Mr. Graham to revoke commercial license number 37463 held by QUALITY CONTRACT SERVICES, INC. OF TEXAS for not having a current qualifying party in place. The motion passed.
US Liquids of LA., L.P. (CL #39957)
Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 39957 held by US Liquids of LA., L.P. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against US LIQUIDS OF LA., L.P. then Judge White asked if a representative of US LIQUIDS OF LA., L.P. was present. There was no response.
Ms. Fitch stated that this matter was seven (7) months passed due, there have been two (2) letters that were sent, but no service was received on those letters.
Staff is recommending revocation of their license.

Continuance – Consider an alleged violation by Ernest Kelly of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Ernest Kelly, acted as a contractor to perform work on the 3220 General DeGaulle project in New Orleans, Louisiana in the amount of $1,000,000.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against ERNEST KELLY then Judge White asked if a representative of ERNEST KELLY was present. Mr. Willie Zanders, Attorney representing Ernest Kelly and Mr. Ernest Kelly were both present.
Attorney Zanders came to the stand and requested that the matter relating to Ernest Kelly and the matter relating to Tim Kelly be kept as two (2) separate matters.
Board Attorney, Trippe Hawthorne responded that the Board has no objection to them being two (2) separate matters.
Board Attorney, Trippe Hawthorne called Frank Muscarello, Compliance Investigator to the stand, he was sworn in. Board Attorney, Trippe Hawthorne reviewed Mr. Muscarello’s duties as an Investigator in the Compliance Section and what Mr. Muscarello found during his investigation into his matter. Board Attorney, Trippe Hawthorne reviewed the exhibit packet with Mr. Muscarello.
Mr. Ernest Kelly came to the stand, was sworn in, introduced himself then stated he was the owner 3220 General DeGaulle property.
Board Attorney, Trippe Hawthorne questioned Mr. Ernest Kelly about the money flow through Tim Kelly – KT and Associates for the construction of the building.
Mr. Ernest Kelly responded he wanted his brother Tim involved in this project and no dealing with the funds and wasn’t involved with any meetings between his brother Tim and the contractors.
Board Chairman asked Ernest Kelly, where is the money for this project and who did he write the checks to.
Ernest Kelly responded the bank puts the money in the account and he pay out when the funds were needed. The funds went to Tim Kelly and he paid the vendors.
Mr. Lambert asked Ernest Kelly if he wrote any checks to any body other than his brother.
Ernest Kelly responded no.
Mr. Jones, Board Member stated for the record pages 5-9 are missing from the AIA Contract for Construction that is in the exhibit packet. Can you substantiate the contract on page 7 between Mr. Kelly and Mr. Williams.
Ernest Kelly responded he thought Mr. Hunter was involved in the project. That several years ago, Mr. Hunter was a client of his but he did not know Mr. Williams. He didn’t read the terms of the contracts, his brother who has fifteen (15) plus years experience working for the School Board and he trusted brother, they made decisions together.
Mr. Meredith asked Ernest Kelly under tab #7 in the exhibit packet is a contract, it is not dated and Mr. Ernest Kelly signed it as the owner. Did you and Mr. Williams sign that contract at the same time. Do you have any idea when the contract was signed.
Ernest Kelly responded he didn’t sign it, he knew Mr. Williams, but didn’t select any of the contractors or people working on this project. No he didn’t he signed it when it was given to him.
Attorney Zanders asked Mr. Ernest Kelly for the record – is the document he was holding has Mr. Kelly’s his signature on it, then requested it be entered into the record.
Judge White asked Mr. Ernest Kelly if he has seen the document under tab #7.
Ernest Kelly responded yes.
Board Attorney, Trippe Hawthorne stated he had no objection to the document being admitted into the record.
Judge White accepted the document into the record. Then stated to the Board they have severed these two (2) matters in terms of the ultimate resolution, however Tim Kelly, the Board feels is a relevant witness (in audible )
Board Attorney, Trippe Hawthorne stated yes the Board may call him as a witness.
Attorney Zanders asked if he could stipulate in terms of liability the part of Ernest Kelly, to clear him yet.
Board Attorney, Trippe Hawthorne, Board Chairman and Mr. Lambert all responded no.
Judge White stated the Board is not ready to make a prejudgment on that, they would like to hear from Tim Kelly.
Mr. Dupuy stated it is clear that there was a contract between the owner of the building and a licensed general contractor, whether he signed it or not. What is the page just behind the contract it is dated August 10th and addressed to Brent Templet. Was it written and signed by Edwin Williams it shows a list of the subcontractors for the project.
Board Attorney, Trippe Hawthorne stated once the cease and desist order was issued the project was stopped Mr. Brent Templet, the State Director of Compliance got a call, he thinks from Tim Kelly asking what needs to be done to get the job started again. Mr. Templet told him he needed to get a licensed general contractor. This next response on this project sent to Board was a copy of the contract and a list of subcontractors list from Edwin Williams and then the cease and desist order was lifted.
Mr. Dupuy asked why would Mr. Williams tell Mr. Muscarello that he wasn’t the general contractor, when he sent this letter with a copy of the contract to the Board saying he was.
Board Attorney, Trippe Hawthorne responded it is fairly consistently that Mr. Williams he was a Construction Manager on this project. In the lawsuit, that they saw for the first time this morning, those allegations were based that he was the construction manager for this project was paid $26,000.00 and still seeking $15,000.00 on an $808,000.00 project.
Mr. Tim Kelly came to the stand, was sworn in and introduced himself as being the President of KT Consulting, that his company designed the building.
Board Attorney, Trippe Hawthorne stated the Board would like to know how the funds flowed for this project and is it fair to say that all of the checks from your brother (Ernest Kelly) were for the funding for the construction of this building and they flowed through his company KT and Associates.
Tim Kelly responded yes, his brother didn’t write checks to the contractors. His firm was liable for the funds and does not sign off on any funds when no work was performed. Ernest wasn’t involved in any role in the construction. His company has the legal documents to the project and had to verify the completion of work.
Board Attorney, Trippe Hawthorne asked Tim Kelly if he managed this project, that he approved and made sure people got paid. Isn’t Mr. Williams sued you, claiming you hired him as a Construction Manager.
Tim Kelly responded they didn’t have a contractual agreement with Mr. Williams, that Mr. illiams is suing Mr. Tim Kelly. He’s got a contract with Ernest Kelly and the Bank has the contract because they would not release any funds without a contract.
Board Attorney, Trippe Hawthorne asked Tim Kelly are you aware that Edwin Williams denied being the general contractor on this project. How much was Mr. Williams paid for his
Tim Kelly responded after the desist order was lifted in July, on the 10th he sent a letter. He doesn’t have the figure with him that he signed lien waiver.
Board Attorney, Trippe Hawthorne asked Tim Kelly how much was Mr. Williams paid for his part on this $808,000.00 contract. In the compliant with the Board that is was $15, $20-$25, $26 thousand dollars.
Tim Kelly responded it can’t be $15 - $20 thousand dollars, that Mr. Williams got a 1099 for $26,000.00.
Board Attorney, Trippe Hawthorne asked Tim Kelly if Mr. Williams was paid .
Tim Kelly responded no, it can’t be $15 thousand or $20 thousand dollars when the document in front of you has $26 plus.
Board Attorney, Trippe Hawthorne asked Tim Kelly it is $26 thousand and didn‘t he receive a subpoena in February to produce all of your documents related to this project.
Tim Kelly responded February of which year . . . the project went over a year plus, which dates are you talking about.
Attorney Zanders responded for the record, at that point he was representing Mr. Kelly. He had asked the Board for a continuance to give him time to learn more about the facts and since the documents were not produced that was his responsibility. It was tax season for Ernest Kelly so he didn’t produce them.
Tim Kelly responded he had a representative at that time.
Mr. Gallo asked Board Attorney, Trippe Hawthorne if those documents were produced.
Board Attorney, Trippe Hawthorne stated no - no – Mrs. Hughes shook her head no.
Attorney Zanders responded they didn’t ask him to produce the documents, he needed time to learn what was going on and knew that there would be a hearing. Mr. Kelly didn’t say he wasn’t gonna send the anything to the Board, Attorney Zanders had to learn what was going on with the case and that is why he told the Board he needed more time.
Board Attorney, Trippe Hawthorne stated the continuance is relevant to the hearing. There was never a continuance issued for the subpoena and there has never been a response made on the subpoena and your honor at this point he would offer an additional objection to the offer, there many exhibits offered by the respondents that have not been produced in light of the pending . . . . (in audible)
Attorney Zanders responded at the point he was the lawyer, any communications about subpoenas that were over due or a motion to compel he should have received that and he didn’t get them.
Judge White stated to Attorney Zanders since your client was asked to produce documents and you sought a continuance of the hearing, the burden was yours to produce the documents. It wasn’t Board Attorney, Trippe Hawthorne‘s responsibility to reissue the request for the documents. Since you requested a continuance or would you pre-admit or waive, give up or surrender your rights to those documents. Who’s got the burden counsel.
Attorney Zanders responded he knew there were be a hearing and would physically bring them in as evidence.
Judge White asked Attorney Zanders you didn’t answer my question who’s got the burden – him (Board Attorney, Trippe Hawthorne) or you.
Attorney Zanders responded since he is the lawyer it was his responsibility, but he decided to bring them today, that he has given Board Attorney, Trippe Hawthorne everything he has.
Mr. Meredith asked Tim Kelly attached to the contract, is that a list of subcontractors that worked on that job, electrical, mechanical, whatever, typically, let’s say the electrical work was done by Dean Walters for $75,000.00. When he billed this project, your firm looked at the bills, so who paid for the electrically. Would your firm, Mr. Ernest Kelly or the Bank issue the check to pay that subcontractor.
Tim Kelly responded his company inspected the work then wrote every check for the work that was performed, it is the responsible of the designer for construction administration.
Mr. Meredith asked Tim Kelly, is it your testimony that all the subs were listed whether it be the steel man, the mechanical, the electrical when they submitted bills, they got paid for the work they performed. Did your firm issue checks to Mr. Williams’ firm or write checks to the individual subs.
Tim Kelly responded all the invoices were submitted by the contractor and or a subcontractor and TK Consulting issues the checks, correct. When Mr. Williams submitted invoices for the subs, the checks were issued in their names.
Board Chairman asked Tim Kelly to explain to the Board what he mean by in their names.
Tim Kelly responded all the invoices were issued, they wrote some to Mr. Williams and his subcontractors
Board Chairman asked TK did you write the check to Mr. Williams or to the subcontractors, about half - fifty percent (50%), so some checks you wrote directly to the subs.
Tim Kelly responded when the invoices were submitted they wrote the checks the way he wanted them written out that is correct.
Mr. Meredith asked Tim Kelly did you write the checks to the subcontractors.
Tim Kelly responded yes – yes.
Mr. Stuart, Board Member asked Tim Kelly if those subcontractors had a subcontract with Mr. Williams and could he provide those subcontracts. If you were writing the checks to the subcontractors after Mr. Williams submitted invoices, why wasn’t Mr. Williams writing the checks.
Tim Kelly responded they had a contract with Mr. Williams, he has never seen them the subcontractors had a contract Mr. Williams. There was a schedule of values in the contract with Mr. Williams and they followed it . . . . . (in audible)
Mr. Stuart, Board Member asked Tim Kelly you are paying all the schedule of values.
Tim Kelly responded that’s correct, they paid based on the schedule of values listed in the contract with Mr. Williams.
Mr. Stuart asked Tim Kelly you didn’t make the schedule of values, but you write checks without making . . . (both talking - in audible)
Tim Kelly responded they have a schedule of values was in the contract that Mr. Williams signed.
Mr. Dupuy, Board Member asked Tim Kelly looking at the list of subcontractors, who wrote the subcontracts, who was responsible for getting the subs to get the work done.
Tim Kelly responded yes – yes.
Mr. Dupuy, Board Member stated so Williams as the general contractor, whether the checks were cut directly to the subs, Williams was acting as the general contractor and the subcontractors worked for Williams and this guy inspecting the work that the subcontractors did, to verify certain amounts. Is his logic wrong here or some thing. He’s ok with you guys saying no . . . laughter from Board members.
Mr. Stuart, Board Member stated when a general contractor writes a subcontract to a subcontractor he would identify the scope of work and that scope of work would be carried out then you would bill for it and you would receive a check from the owner as the general contractor and pay the subcontractors. So by having the owner pay the subcontractor and he has never seen the subcontract and you say there is one, but nobody produced one between Williams and the subcontractor.
Mr. Jones, Board Member asked Tim Kelly earlier this morning the Board’s investigator stated he went out to the job site and saw a sign bearing either your name or your company’s name as being the construction manager, could you explain that.
Tim Kelly responded he (the investigator) saw a banner that their company epresenting them were the design firm was part of a $3 million dollar development. They brought McDonalds to that site, they are proud to put their banner up, that doesn’t accuse him, that doesn’t show proof that he’s a contractor. Frank was out there, he picked him as a contractor when he met Mr. Tim Kelly on the 14th of April at the Clerk of Court Office in Gretna. He asked Mr. Kelly the question what he was working on.
Mr. Jones, Board Member asked Tim Kelly to be more responsive to the question, what did the sign say – please sir.
Tim Kelly responded the sign says Small Real Estate Development Firm - TK Consulting.
Mr. Jones, Board Member stated to Tim Kelly it says KT Real Estate Development.
Tim Kelly responded right.
Mr. Jones, Board Member asked Tim Kelly no where on the sign did it say construction management.
Tim Kelly responded they had a bunch of stuff on there.
Mr. Jones stated to Tim Kelly sir answer the question, did it have construction management on the sign or not.

Mr. Jones, Board Member asked Tim Kelly you are the designer - you are the professional of record.

Mr. Jones, Board Member stated by state statute being a designer himself, it does not allow him to do any construction management, so his question for you (Tim Kelly), for the record, did that sign say construction management.

Tim Kelly responded what – that’s dated October 14, 2009.
Board Attorney, Trippe Hawthorne asked Tim Kelly that’s a request from Mr. Templet, State Compliance Director to Mr. Williams asking him for documents such as quotes, bids, permits, bonds, contracts, subcontracts and, payroll records.
Tim Kelly responded yes.
Board Attorney, Trippe Hawthorne asked Tim Kelly then two (2) pages after that, you’ll see Mr. Williams’ response, “that he doesn’t have any of the information you requested in your letter”. His role in the project was as a construction manager.
Tim Kelly responded yes, he sees Mr. Williams’ letter, after that, a letter was issued to him from his brother.
Attorney Zanders asked Tim Kelly he presented to counsel certain documents, the contractor’s application for payments and they bear your signature. Will you state for the record that these documents are part of the business records.
Tim Kelly responded they are and they were notarized.

Attorney Zanders stated they would like to reoffer those documents into the record.
Judge White asked Board Attorney, Trippe Hawthorne since you he has already objected, did he want to explain your objection to that. Is your objection that they failure to comply with the Board’s subpoena request for those documents and the defense offered by Tim Kelly is that he turned it all over to Mr. Zanders and Mr. Zanders did not comply with that, he issued that direct question whose got the burden on that
Attorney Zanders responded Judge he didn’t have them then.
Judge White stated you acknowledged that you had the burden, sir, is that correct.
Attorney Zanders responded Judge what he acknowledged was it was his responsibility. That he had in the record a letter stating he needed time to meet with his clients to learn more about the case. First he didn’t have the document then he had to get the documents, so he decided to bring with him today.
Judge White stated it puts the preparation of the Board’s case at a disadvantage. Now the question for Judge White to rule on is whether or not he is going to admonish him that you failed to follow through with what the Board expected and let them in or exclude to the prejudice of your client.
Attorney Zanders responded he accepts that admonishment.
Judge White asked Board Attorney, Trippe Hawthorne if he wanted to be heard on that.
Board Attorney, Trippe Hawthorne responded no Judge, no.
Judge White stated to Board Attorney, Trippe Hawthorne if you are surprised counsel, as I suspect you are, the hearing could be postponed to a later date to allow you to respond to the surprise that you now have in these matters coming forward. But he thinks in the interest of justice, he’s gonna let them in over your (Board Attorney, Trippe Hawthorne) objection and if in deed you need further time to address them at a later Board date then that’s going to be your ruling.
Board Attorney, Trippe Hawthorne offered and file introduce into evidence the documents discussed in testimony and the rest contained in the exhibit packet and the copies of the petition filed by Edwin Williams vs. Timothy Kelly and TK Consultants.
Judge White asked Attorney Zanders if he had any legal objections to the introduction of the documents that have been identified or proffered.
Attorney Zanders stated no Judge no objection.
Judge White stated they would be stamped and admitted into the record. Then Judge White asked if there are any other witnesses that they wish to call.
Attorney Zanders responded Judge he believes that the licensed contractors were an part of this and the Board should have has them here to prove or disprove what these documents show. He thinks his clients should be given the benefit of the doubt because they are here and represented fully and the fact that the licensed contractors are not here, he doesn’t think they should be punished for that Judge because they are not here to defend what’s in writing.
Board Attorney, Trippe Hawthorne stated your honor he is not sure if that is in a form of a motion or a request to you, but he would suggest that opposing counsel certainly have the opportunity to issue subpoenas and have whatever witnesses here he would like to, to testify. He is not sure what the complaint is.
Judge White responded so your position is that no adverse assumption should be concluded . . . . (both speaking – in audible), have you concluded with all your witnesses.

Judge White stated to sum this up, Mr. Zanders you’re essentially just summed up before the Board. Mr. Hawthorne do you want to be heard in way of a rebuttle argument before the Board takes some sort of action.
Board Attorney, Trippe Hawthorne responded your honor he would just like to point out to the Board that the staff and the investigators are put in a difficult position when they ask people straight forward questions and people give them different answers, when they ask people for documents and people fail to produce them, when subpoenas are ignored and so sometimes what we have to do is call multiple people for hearings and in this instance from a prehearing Memorandum that the suggestion was either that Mr. Ernest Kelly or Mr. Tim Kelly acted as an unlicensed contractor. He would suggested that based on the evidence we have seen and heard here, it sure looks like to him it was Tim Kelly, not Ernest Kelly, but that is a decision for the Board. Excuse him Tim Kelly not Ernest Kelly.
Attorney Zanders responded he will state this briefly, as a lawyer for thirty-three (33) years he sees the confusion and he agrees that any person licensed by this Board who sign any documents should be held accountable. He agrees that Tim Kelly was more involved in the work than he would have allowed, but it doesn’t mean he was practicing as a general contractor, it doesn’t mean he intentionally or negatively violated any of the Board’s policies because Mr. Williams was there the whole time and the law suit is a personal dispute brought against Tim Kelly’s company and not Ernest Kelly. Judge he apologizes for not getting these
documents to you earlier, but he thinks if he would have had that cooperation he doesn’t think the Board definitely wouldn’t have called Ernest Kelly in and he apologizes that we’re at this point, but he has only been involved in this about 6 weeks now and next time if any of his clients come before the Board Judge he’ll get things in quick.
Mr. Lambert stated he thinks that the 2 Kelly brothers were in this together and he thinks Tim Kelly clearly was acting as construction management without any doubt but it with his brother’s consent and agreement to do it and they purposely have kept it in the dark in the shadow would not produce the information, if there is any better information he thinks in spite of this the lawyer did a terrific job trying to defend them, but it didn’t clear up with him and he’s ready to make a motion.

Continuance – Consider an alleged violation by your BOURQUE CONSTRUCTION CO., INC. client of the provisions of Louisiana R.S. 37:2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 5, in that you have permitted your contractor’s license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, at the Wal-Mart Super Center, project located in Opelousas, Louisiana.
Mrs. Bobbie Hughes read the allegations against BOURQUE CONSTRUCTION CO., INC. then Judge White asked if a representative of BOURQUE CONSTRUCTION CO., INC. was present. Mrs. Jennifer Morris, Attorney representing Bourque Construction and Mr. Jerry Bourque were both present.
Mrs. Hughes stated that a Settlement Offer in the amount of $1,000.00 plus $500.00 Administrative Fees for a total of $1,500.00 has been received from Bourque Construction, but there are others involved in this matter and they will be heard at the July Commercial Board Meeting. Then Mrs. Hughes asked if the Board if they wanted to reject the offer and continue this matter until July.

This hearing is being called for reason that on information and belief, Boitnott Plumbing, LLC, entered into a contract with an unlicensed contractor to perform work on the Geaux Clean Express Car Wash project in Central City, Louisiana in an amount in excess of $10,000.00.
Mrs. Bobbie Hughes read the allegations against BOITNOTT PLUMBING, LLC then Judge White asked if a representative of BOITNOTT PLUMBING, LLC was present. Mr. Jimmy Boitnott was present.
Mr. Boitnott came to the stand, was sworn in then pleaded Not Guilty to the allegations against Boitnott Plumbing, LLC.
Board Attorney, Trippe Hawthorne called Todd Brady, Compliance Investigator to the stand, he was sworn in. Board Attorney, Trippe Hawthorne reviewed Mr. Brady’s duties in the Compliance Section and what Mr. Brady found during his investigation into his matter. Mr. Gallo stated that the Committee hasn’t had any meetings. There is a Bill is the legislature to raise the limit for Mechanical/Plumbing contractors. They have discussed it with Mr. McDuff and Mr. Meredith.
Mr. McDuff spoke about Act 725 information and how they have been trying to get the word out to people around the state about it. There was a meeting held earlier that morning with Trade Associations, hoping they will defend/support Act 725 in the legislature.
