The cartel's supply quotas aren't guiding the market these days.

London -- When oil prices were soaring in early 2008, the Organization of Petroleum-Exporting Countries was under intense pressure to raise its supply quotas. When they plummeted at the end of last year, OPEC had to scramble to cut them; now? Supply and demand simply don't mean much anymore, after six months of rallying stock markets and a ramp-up in investor optimism, and OPEC meeting is unlikely to change things.

Oil prices have risen in tandem with global stock markets over the past six months to around $70 per barrel, despite the fact that demand for oil is weak and inventories remain high. In such an environment, it's no wonder that OPEC officials are ruling out a cut in supplies ahead of the meeting; Saudi Arabian oil minister Ali al-Naimi was even cited as saying that the price was "good for everybody" at the moment.

So who is really in control of the oil price as the market braces itself for a post-summer lull? According to Eugen Weinberg, an analyst with Commerzbank, the power lies in the hands of the Commodity Futures Trading Commission in the United States. The regulator is preparing to crack down on excessive speculation in commodities markets, and has already promised "vigorous" enforcement of trading position limits.

Weinberg predicts oil prices will trade between $65-$75 per barrel after the OPEC meeting and will eventually drop to $50 by the end of the year, with a potentially rapid fall if the C.F.T.C. comes out with a crackdown that is more rigid than expected. "The power of OPEC at the moment is really low," said Weinberg.

Valero Running Anti-Cap & Trade Campaign

Says legislation will cost motorists at pump if it becomes law

San Antonio, Texas -- Valero Energy Corp. is launching a campaign against proposals to lower carbon emissions by posting signs at its gas stations warning customers about the projected high hike in fuel prices if the U.S. House-approved legislation on carbon cap-and-trade becomes law, reported The San Antonio Express-News.

The campaign begins today at all facilities owned by Valero, which has refineries and retail outlets in 40 states. The U.S. Department of Energy projects that gasoline prices could increase by 77 cents per gallon over the life of the climate-change bill, said the report. House Energy & Environment Subcommittee, was narrowly approved by the House on June 26.

Valero, the largest U.S. independent refining company, estimates that its costs for carbon emissions would total $6 billion to $7 billion a year, depending on the auction costs of the permits.

The bill, which would force businesses to pay for their carbon emissions, would hit U.S. refining companies especially hard because refiners must account for both emissions from refineries and from the vehicles that burn the fuels, Jim Greenwood, Valero Energy vice president for governmental affairs, told the newspaper.

The minimum limit for permits is $25 per ton of emissions. Valero refineries emit about 30 million tons per year, but vehicles using Valero fuels emit another 250 million tons of greenhouse, heat-trapping gases, the report said.

San Antonio-based Valero, with 2008 revenues of $119 billion, owns and operates 16 refineries throughout the United States, Canada and the Caribbean with a combined throughput capacity of approximately three million barrels per day, making it the largest refiner in North America and is one of the nation's largest retail operators with approximately 5,800 retail and branded wholesale outlets in the United States, Canada and the Caribbean under the Valero, Diamond Shamrock, Shamrock, Ultramar and Beacon brands.

The Motor Vehicle Owners’ Right to Repair Act Reintroduced in Congress - HR 2057

The Motor Vehicle Owners’ Right to repair Act, Legislation that allows consumers to continue to choose where they have their vehicles repaired was reintroduced into the11th Congress on April 22, 2009.

“HR 2057, known as the Right to Repair Act goes to the heart of American property rights and ownership.  When motorists purchase their vehicles, they should have the right to own their vehicles electronic, diagnostic and repair information so they can make affordable and convenient repair choices, whether that choice is an independent repair shop or a car dealership,” said Ray Pohlman, President of Coalition for Auto Repair Equality (CARE).  “As vehicles become more computerized, soon customers will be very limited on repair options.  In some cases, they will be forced to take the vehicles back to the new car dealerships even when their vehicles are out- of- warranty”.

Vehicles that are 1994 and newer (and some earlier models) are equipped with computers that control the repair and service information on most of the vehicles’ systems, including, but not limited to: airbags, brakes, emissions (check engine light), tire pressure, oil changes, electronics, ignition systems and keys and transmissions.  In many cases, the only way for motorists to have these systems repaired is to return to the new car dealership.

The Automotive Aftermarket Industry Association (AAIA) conducted a ‘first-of-its-kind’ study, which illustrated the enormous cost-benefit to consumers when their vehicles are repaired in the independent repair industry.  The study clearly showed that repairs conducted at new car dealerships cost consumers on average 34 % more than at the independent repair shops, thus resulting in $11.7 Billion in excess costs annually.  Los Angeles consumers pay, as much as, 46.8% more at new car dealerships, for repairs. The Right to Repair Act will help all of America’s motoring consumers.

Arron Lowe, Vice President, Government Affairs for AAIA, stated, “with dealerships closing at unprecedented rates, the ability for consumers to obtain convenient and affordable repairs from their local independent vehicle repair shops is more important than ever.  Right to Repair ensures that independent shops have access to the most up-to-date information, tools and software so that they continue to maintain and repair their customers’ late model vehicles.”

The Exxon Mobil sabotage case

The case in which Exxon Mobil Corp. is accused of sabotaging wells it has abandoned.

In 1989: Exxon and Texas landowner cut off negotiations on royalty payments. In 1991 Exxon plugs its wells on the disputed land. In 1994 a smaller company tries to open Exxon well sites that were closed. and says it can't drill. Accuses Exxon of sabotaging the wells and later files suit along with landowners.

In 1999 civil jury rules against Exxon, awards $18.6 million. Appeals court later upholds decision.

In 2009 Texas Supreme Court overturns verdict on most counts.

Alert Reminder! Candy- and Fruit-Flavored Cigarettes Now Illegal

Washington -- This is to remind all retailers that effective September the 22nd the FDA's ban on candy and fruit-flavored cigarettes flavored cigarettes are illegal.

The FDA is also examining options for regulating both menthol cigarettes and flavored tobacco products other than cigarettes. 

"Almost 90 percent of adult smokers start smoking as teenagers. These flavored cigarettes are a gateway for many children and young adults to become regular smokers," said FDA Commissioner Margaret Hamburg in a press release. "The FDA will utilize regulatory authority to reduce the burden of illness and death caused by tobacco products to enhance our Nation's public health."

"Flavored cigarettes attract and allure kids into lifetime addiction," said U.S. Department of Health and Human Services Assistant Secretary for Health Howard Koh. "FDA's ban on these cigarettes will break that cycle for the more than 3,600 young people who start smoking daily."

The FDA is taking several steps to enforce the ban. A letter recently sent to the tobacco industry provided information about the law, and explained that any company who continues to make, ship or sell such products may be subject to FDA enforcement actions.

Thieves Steal $14,000 Worth of Gasoline

Clearwater, Fla. -- A BP gas station here was the target of a gasoline thief, as police report someone stole 6,000 gallons of gasoline from the location in less than 23 minutes, according to a My Fox Tampa Bay news report.

Convenience store clerk Frank Zaitoun told the news outlet the theft came as a shock. "It’s something that’s never happened, you know. Never happened," he said.

According to the report, the station's tank monitoring system showed 6,000 gallons were removed Saturday between 11:12 p.m. and 11:35 p.m. Police spokesperson Elizabeth Watts said officers were called out hours later.

"There was a heavy smell of gasoline in the area. When they went out, they found a pool of fuel and the storage gas caps removed," Watts said.

Clearwater police are trying to figure out who's responsible for stealing the gas, but believe whoever did it knew exactly what they were doing.

"They knew how to get the gas caps off the underground storage tanks and how to get the fuel out so it’s definitely someone who has to know about the system," Watts said.

Zaitoun said when he and his manager arrived at work; they noticed the gas alarm was going off, indicating they were out of gas. When they checked the fuel pumps they realized thousands of gallons of fuel were missing.

Police describe the getaway vehicle as a silver tanker truck.

The stealing of gasoline and diesel has been a problem for gasoline retailers. All retailers should have security cameras and be vigilant. There are many ways for crooks to steal motor fuel.

Small Business Will Pay More Under Energy Bill 

The climate change bill will cost consumers and small-business owners a lot more.

Columbia, S.C. – The U.S. House-passed climate change bill will cause small businesses and consumers to pay a lot more for utilities, wrote J.J. Darby in a guest column in the Greenville News.

The bill would require energy utilities to buy government credits to offset greenhouse gas emissions, which would in turn become “an energy tax on the American people as the utilities pass the increased costs along to consumers and small-business owners,” Darby pointed out. The cap-and-trade plan will allow the government to limit the amount of greenhouse gases, which will let businesses that lower their emissions below that cap to sell their credits to other companies.

“However, in the initial phases, more than 80 percent of the credits will be given away by the government rather than auctioned off as originally planned. The credits will go to big businesses handpicked to garner enough support to pass the bill out of the House Committee on Energy and Commerce,” Darby wrote.

President Obama even pointed out that the bill’s proposals would cause energy rates to soar. “Under my plan of a cap-and-trade system, electricity rates would necessarily skyrocket,” said Obama last year in the San Francisco Chronicle. The House Ways and Means Committee projected between 1.8 million to 5.3 million jobs would be lost under the bill.

“That’s because big businesses will pass the cost on to small businesses and consumers in the form of higher prices. An analysis by the Massachusetts Institute of Technology of a less-restrictive bill in the last Congress estimated electricity rates would go up at least 40 percent,” Darby wrote.

Ga. Chain Owners Face Indictments

Charges include miscalibration of pumps, grade substitution, bribery and more:

St. Marys, Ga. -- The former owners of a chain of gas stations in southern Georgia now face a 17-count indictment accusing them of fraud, reported First Coast News. According to the indictment, Cisco stations defrauded customers out of at least $7 million in 2005 and 2006.

Acting U.S. Attorney for the Southern District of Georgia Joseph D. Newman said a grand jury in Savannah, Ga., returned the indictment last week accusing the owners of Cisco Travel Plazas of several crimes.

Named in the indictment are Fairley Leslie Cisco, Robert Michael Clark, Regina Dianne Cheung Pierce, Winston Eric Cisco and Britt Clinton Moore. Each faces charges including conspiracy and mail and wire fraud, said the report.

Fairley Cisco, who the indictment says operated three Cisco stations in Camden County from the mid-1990s until late 2006, also faces a charge of criminal trademark infringement, the newspaper added.

The indictment came from an investigation into Cisco Travel Plazas, which were sold and renamed in 2006.

The paper said that the accusations laid forth in the indictment say that the defendants conspired to:

Miscalibrate pumps to sell less gasoline than the meter indicates.

Substitute regular gasoline in the mid-grade and premium pumps.

Bribe inspectors in charge of fuel pumps.

Sell non-BP gasoline where the BP trademark is displayed.

Make false statements to investigators.

Clark has been arrested, and warrants for arrest remain outstanding for Fairley and Eric Cisco, the report said.

These few bad apples and dishonest businesses harm the entire industry.

Driving down, mass-transit use growing

Hounded by a recession and high gas prices, motorists drove less last year and caught more rides on mass-transit systems, a new national transportation survey has found.

In Florida, with its heavy dependence on roads, the actual miles traveled was flat, but trips taken on buses and, in South Florida's case, trains, rose about 3 percent, according to the study sponsored by Environment America, a nationwide group that promotes green energy use.

Among the states that saw the biggest drops in miles traveled by car or truck were Georgia, California, Michigan and Connecticut. Those with the biggest mass transit increases included Louisiana, Maryland, Delaware and Utah.

Gasoline Brand Loyalty a Matter of Age, According to New Study 

Younger drivers less brand loyal than older drivers.

Houston, TX –Generational differences have led to a steady drop in consumer brand loyalty when purchasing gasoline, with consumers over 65 more likely to limit gasoline choices to one brand, and younger consumers more willing to “shop around,” according to the NPD Group’s latest Motor Fuels Index, which tracks consumer motor fuel purchasing behavior.

NPD reported that the percentage of consumers who “always buy one brand of gasoline” measured 28 percent in the first quarter of 2009, compared to 34 percent in the same quarter of 2000. Compared to the 2000 respondent group, the age 30 to 44 segments registered the sharpest decline in brand loyalty and is the most likely group to sample multiple brands among consumers who have purchased a major brand.

"I believe we can expect the trend to continue as drivers, ages 18 to 29, also exhibit less loyalty than previous generations," said David Portalatin, industry analyst for NPD`s automotive unit. "This group is beginning to be influenced by the `echo boom, ` children of Baby Boomers, who will be the largest generation of drivers in the history of the automobile."

Florida Adds Lottery Vending Machines 

The state has installed 1,000 ticket vending machines primarily at supermarkets.

Tallahassee, Fla. – The Florida Lottery has added 1,000 ticket vending machines to sell scratch-off tickets at lottery retailers across the state, the Lottery Post reports. Primarily at supermarkets, the vending machines will bring in an additional $3.4 million in annual lottery profits, the state predicted.

“It helps both our retailers and our players because it is a convenience for both,” said Connie Barnes, a Florida Lottery spokeswoman.

The vending machines will begin to be placed in Miami-Dade and Broward counties, with other south Florida locations to come. The machines accept only bills, no cards or credit cards, and offer a range of games, from $1 Triple Win to $600 Million High Roller tickets.

The state has safeguards in place to prevent children from playing the lottery. By law, lottery players must be 18 to buy scratch-off games. The new machines have a remote control switch that store personnel can use to shut down the machine if a minor tries to buy a ticket.

This year, Florida sales of scratch-off tickets have dipped slightly from 2008, but lottery officials are banking on the new machines to boost that revenue. Florida tried automated ticket sales back in the late 1990s, but did not see revenue increase. This time around, the new machines hold more tickets and are easier for retailers to restock.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service

The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free

e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.
