EMBRY-RIDDLE AERONAUTICAL UNIVERSITYPrescott CampusPA 4-1 ACADEMIC CHEATING, PLAGIARISM, Approved 5/16/07AND FRAUDPURPOSE: To provide a procedure to handle cases involving academic cheating, plagiarism, and fraud.POLICY: Academic cheating, plagiarism, and fraud are detrimental to the academic process and will not be tolerated. It is the policy of the University that students and faculty shall have access to due process in cases of cheating, plagiarism, and fraud. There shall exist an avenue of appeal when sanctions are proposed at the department level. The appellate body shall include representation from faculty and students.PROCEDURE:Within five class days after the incident or knowledge of the incident, the instructor shall 1) confront the student with the alleged act and 2) complete Part I of Academic Integrity Violation Report Form (Attachment 1). The student then selects a course of action and signs Part I. If the student accepts the recommended sanction, the instructor will keep a copy of the form for his/her records and forward a copy to the Associate Dean for the student’s primary degree program. The form will not become a part of the student’s permanent record.If the student desires a hearing, the instructor shall set up a hearing with the instructor’s department chair and the student to discuss the allegations and the evidence. This hearing shall be held within five class days of the initial meeting between the instructor and the student.After reviewing the evidence, the department chair shall, within two class days; arrive at a decision, establish a sanction, and complete Part II of the form. Sanctions proposed by the department chair may include dismissal of charges, warning, failure on a particular test/paper/project, failure in the course, suspension or dismissal from the University. This sanction will go to the Associate Dean for Academic Support. Copies are distributed to the student and instructor. The student has five class days to appeal the sanction to the Associate Dean for Academic Support. If, after five class days, the Associate Dean for Academic Support has not received a written petition of appeal, the original form goes to the Records Office and a copy is sent to the Department Chair and the sanction is administered as stated.If the Associate Dean for Academic Support receives a written petition for appeal within the five-day period, the Speaker of the Faculty will be notified to form and convene the Academic Integrity Board.If the final result is suspension or dismissal, the Director of Records will be notified by the instructor, department chair or dean. The student’s transcript will be notated.Academic Integrity BoardMEMBERSHIP:The Speaker of the Faculty shall convene the AIB. This board will be made up of two faculty members appointed by the Speaker of the Faculty, two students appointed by the President (or designee) of the Student Government Association, and the Speaker of the Faculty or designee acting as the chairperson. The Associate Dean for Academic Support shall serve as a resource person and is a non-voting member.PROCEDURE:The AIB shall be convened in an advisory body to the College Deans by the Speaker of the Faculty to hear appeals in cases involving academic integrity. The student, instructor, and the department chair will be notified in writing as to the time and place of the meeting.The Associate Dean for Academic Support shall provide a copy of the Academic Integrity Violation Report Form and the letter of appeal to the committee chairperson for review prior to the hearing.At the time of the hearing, the AIB will hear the case from the instructor and the student, and any other pertinent witnesses, including any witnesses the student may wish to present in his/her behalf.The AIB will judge violation or not violation by a simple majority vote, conducted by secret ballot, and inform the College Deans of this judgment and recommended sanctions. A minority report may be filed with the College Deans by any member(s) of the AIB within one class day of the hearing.The College Deans shall make the final decision as to sanctions based upon the findings of the AIB. The sanctions shall be described in the form of a letter to the student, the instructor and the department chair.
