Understanding FERPA and Directory Information

The Family Educational Rights and Privacy Act (FERPA), a Federal law, requires that the Hudson City School District obtain your written consent prior to disclosure of personally identifiable information, such as academic or medical information, from your child’s education records. However, Hudson Schools will disclose appropriately designated “directory information” without written consent, unless you have advised the district in writing within 14 days of signing-off on your student’s handbook, that you do not want your child’s directory information disclosed.

The Hudson City School District uses photos and video of educational programs and school-related activities to recognize and promote students in the media. This includes usage in print, broadcast, website, social media and district publications. If you do not want your child’s photo to be included in school publicity, news stories, including awards, honors and recognitions, you must notify the district in writing within the first 14 days after receiving this information.

Directory information, which is information that is generally not considered harmful or personally invasive if released, can also be disclosed to outside organizations without a parent’s prior written consent.

The primary purpose of directory information is to allow Hudson Schools to include or use this type of information in/or for all district publications or systems, multimedia, web and video programs; honor roll, graduation programs and not-for-profit organizations. Exceptions to the non-profit regulation include companies that manufacture class rings, or are contracted to take school photos or publish yearbooks.

In addition, federal law requires school districts receiving federal funds to provide military recruiters, upon request, a student’s name and address and telephone number, unless the parent has provided the district written instructions not to release their student’s directory information to the military.

Student name Participation in activities and sports

Parent name Weight and Height of athletes

Parent Email Address Degrees, honors, awards

Address Dates of attendance

Telephone Number Educational agencies or institutions attended recently

Grade level Major Field of study

Date and place of Birth

Students participating in performance groups or athletics that are open to the general public are subject to any and all publicity. Public events are not protected under FERPA.

The Federal laws are: Section 9528 of the ESEA (20 U.S.C. 7908), as amended by the No Child Left Behind Act of 2001 (P.L.107-110), the education bill, and 10 U.S.C. 503, as amended by section 544, the National Defense Authorization Act for Fiscal Year 2002 (P.L. 107-107), the legislation that provides funding for the Nation’s armed forces.
