REGULAR MEETING

MONDAY, MARCH 1, 2010

The Mayor and Council of Boonsboro Regular Meeting Session convened at 7:00 PM in the Eugene C. Smith Community Center with the pledge and invocation. In attendance were Mayor Charles Kauffman, Jr., Assistant Mayor Howard Long, Council Members Kevin Chambers, Richard Hawkins, Sr., Natalie Mose, Cynthia Kauffman, and Barbara Wetzel. Also present were Town Manager Debra Smith, Planning Director Megan Clark, Police Chief Jeff Hewett, and Administrative Assistant Kimberly Miller.

• Motion by Council Member Cynthia Kauffman, second by Council Member Chambers to approve the February 1, 2010 Regular Session Minutes, and motion carried.

• Motion by Council Member Chambers, second by Council Member Mose to approve the February 22, 2010 Workshop Session Minutes as amended, and motion carried.

• Motion by Council Member Wetzel, second by Council Member Cynthia Kauffman to approve the February 22, 2010 Executive Workshop Session Minutes, and motion carried.

Motion by Council Member Hawkins, second by Council Member Cynthia Kauffman to approve the February 2010 Treasurers Report and motion carried.

Motion by Assistant Mayor Long, second by Council Member Chambers to approve the February 2010 Bills to be Paid, and motion carried.

CORRESPONDENCE

• Letter announcing the Fiscal Year 2011 Tri-County Council ARC Project Funding with preliminary applications due by April 15, 2010.

• “If I Were Mayor” Contest 4th grade assembly rescheduled for March 11, 2010 at Boonsboro Elementary School.

• Mayor addressed the 8th grade students at Boonsboro Middle School during the Local Government Assembly on February 18, 2010.

• Washington County Solid Waste Management and Recycling Plan Draft 2010-2020 available for a 60 day review and comment period.

• Announcement from Josh Russin that MEMA will host Snow Reimbursement Workshops.

• Letter from US Census Bureau to encourage citizens to assist in the 2010 Census count.

• Thank you letter from Mary Jane Blickenstaff, President of the Boonsboro Rescue Company, for the snow removal assistance by the Town.

• Letter from Richard Willson announcing the Rent to Own Program through the Washington County Housing Authority.

• Invitation to the Mayor and Council to participate in the Sharpsburg Memorial Day parade on May 29, 2010.

• Washington County Economic Development Celebration of Business Banquet will be held on April 20, 2010.

• Big Brothers and Big Sisters of Washington County Bowl for Kids Sake at Turners Dual Lanes on April 18, 2010.

• Article in the Herald-Mail Newspaper on March 1, 2010 about the Boonsboro Waste Water Treatment Plant.

• County Commissioner presentation on “The Recycle Bank” and information on County Wide Recycling Program on March 2, 2010 at 11:00 AM.

UNFINISHED BUSINESS:

Resolution 2010-01; Memorandum Of Understanding Regarding the Town of Keedysville Water Infrastructure Upgrades - due to provisions established by a Water System Agreement between Boonsboro and Keedysville, MDE is requiring that Boonsboro sign the plans for the Keedysville water infrastructure upgrades giving approval of the proposed upgrades to the shred system. A Memorandum of Understanding clarifying Boonsboro’s conditions under which the Mayor’s signature will be provided to the project drawings is being requested for introduction and approval as Resolution 2010-01. Motion by Council Member Chambers, second by Council Member Cynthia Kauffman to approve Resolution 2010-01; Memorandum Of Understanding Regarding the Town of Keedysville Water Infrastructure Upgrades. Motion carried unanimously.

NEW BUSINESS:

Maryland Energy Administration (MEA) – EmPower Clean Energy Communities Grant Agreement- Town Manager Smith stated that a telephone conference with MEA on February 18, 2010 explained project uses and funding requirements in which the programs Clean Energy grant funds could be used. She further stated that a major concern for many of the municipalities is that it will cost more to implement the program in order to meet the grant guidelines and the Federal Regulatory Requirements than most Town’s will receive in funding allocations. Therefore, MEA stated that they might consider developing a list of project options that can be implemented more easily by the towns receiving a small allotment to minimize the administrative requirements. Town Manager Smith stated that a Program Technical Consultant would be contacting each town to coordinate their project, but recommend the grant agreement be signed by March 5, 2010, which does not obligate the Town to participate in the program if they should choose to opt out. She further stated that Boonsboro’s allotment would be $19,000. Motion by Council Member Cynthia Kauffman, second by Council Member Chambers to approve the signing of the Agreement to move forward with the MEA EmPower Clean Energy Communities Grant. Motion carried unanimously.

Washington County American Recovery and Reinvestment Act (ARRA) Funding Allocation to Municipalities Agreement -Town Manager Smith stated that Washington County has allocated $37,815 to Boonsboro to be used towards construction improvement projects, and that the Memorandum of Understanding for these funds must be executed and returned to the County by March 31, 2010, followed by the submission of project plans, specifications and estimates within 90 days of executing the MOU. Town Manager Smith explained that engineering cost proposals have been obtained from ARRO and CDM for engineering a permanent roadway-entrance into the Police Department off the new Park entrance, but further clarification is needed to prepare a fair comparison, which will be presented at the March workshop. Motion by Council Member Hawkins, second by Council Member Cynthia Kauffman to approve the signing of the MOU for the Washington County ARRA Funding Allocation to Municipalities Agreement. Motion carried unanimously.

Annual Post 10 Easter Egg Hunt Donation and Use of Park Request - Mayor Kauffman stated that the Town received a request from the American Legion Post 10 for use of Shafer Park for their Annual Easter Egg Hunt on Sunday, April 4, 2010. He further stated that the Town provides an annual $100 donation to the American Legion for the Easter Egg Hunt. Motion by Council Member Hawkins, second by Assistant Mayor Long to approve the use of Shafer Park on April 4, 2010 and a $100 donation to the American Legion for the Annual Easter Egg Hunt. Motion carried unanimously.

Spring Bulk Pick Up – The Mayor and Council decided on an alternative method to the traditional bulk pick up this year to reduce costs, which includes the placement of Town provided roll-off bins in the Shafer Park parking lot for Town residents to deposit bulk trash items, and having Town employees assist those residents that cannot transport their items to the Park. Motion by Council Member Wetzel, second by Council Member Chambers to approve the Spring Clean Up on Saturday, April 24, 2010. Motion carried unanimously.

Green Fest – Council Member Wetzel stated that it was discussed in the Workshop that Green Fest is an official Town event and that the Town will cover the liability insurance under the LGIT Policy for Green Fest on May 8, 2010. Motion by Council Member Wetzel, second by Assistant Mayor Long to approve Green Fest as an official Town event and to cover the liability insurance under the LGIT Policy on May 8, 2010. Motion carried unanimously.

COMMISSION REPORTS

Planning Commission - M. Clark. Meeting canceled due to snowstorm. Planning Director Clark announced that she attended the Washington County South County Elementary School Site Selection meeting.

Police and Public Safety Commission – H. Long. Meeting canceled due to snowstorm.

Police Chief Report – J. Hewett. The Police Department received 376 calls for service, which included 40 motor vehicle violator contacts and 5 parking citations. Arrests for the month of January included three (3) adults and zero (0) juveniles.

Utilities Commission – K. Chambers. Meeting canceled due to snowstorm.

Park Board – R. Hawkins. Meeting held on February 24, 2010. Discussions included the scheduling of the Wagon Train Event, Boonsboro High School, and Middle School Band performances in the Park, Child Identification Program (CHIPS) returning during National Night Out and possibly the Independence Day Celebration, and the speakers need to be checked in the Park by May.

Town Manager – D. Smith.

▪ Final inspection/approval of the Waste Water Treatment Plant by MDE on Thursday, March 4, 2010 at 11AM.

▪ POS Funding presentation on Thursday, March 4, 2010 at 4 PM at HCC.

▪ MEMA (Snow) Recovery Workshop on Friday, March 5, 2010 at 1 PM at Allegheny College in Cumberland, MD.

▪ Thank you letter from the Park Board to the Town employees for decorating Shafer Park at Christmas.

Council Member Chambers commended the Town staff on the terrific job of removing the snow and plowing during the storms. He stated that Middletown utilizes an emergency communication system to notify it’s town residents of snow emergency and closings and suggested that such a system would be beneficial for Boonsboro and also provide a more efficient means to notify residents of water line repairs, changes in trash days and street closures.

Council Member Wetzel stated that she would like to have the Workshop Meeting Minutes posted on the Town website. Motion by Council Member Wetzel, second by Council Member Cynthia Kauffman to approve the posting of the Workshop Minutes to the Town website. Motion carried unanimously.

CITIZEN COMMENTS

Barinda Golden – Thank you to Town employees and the Police and Public Safety individuals for their help, and good work during the snowstorms.

LeAnn Johnson – Commented on Council Member Chamber’s suggestion to use an emergency communication notification system. Ms. Johnson stated that she hopes that the Town will still notify people who live outside of Town of emergencies and other information via the newspaper and website if a notification system is put into effect.
