CALL TO ORDER
Mr. Nowell called the meeting to order at 5:25 p.m.
REVIEW OF MINUTES
The Board reviewed the minutes of the November 27, 2007 meeting. Mr. Kotrch made a motion, seconded by Ms. Harris, to approve the minutes as presented. The motion was unanimously carried.

Report from Ms. Kelly Regarding Center for Medicare & Medicaid Services Final Draft Regulations as Noted in the November, 2007 Federation News Briefs
Ms. Kelly reported that she had reviewed the final draft regulations. No Board action was necessary.
Change to Application Form
Board members were provided with a copy of the application showing the language added certifying that an applicant does not have a social security number. The following language was added under question number 6: “If you do not have a social security number, please sign below and certify that you do not have one.” Mr. Smith made a motion, seconded by Mr. Kotrch, to approve this language under question number 6. The motion was unanimously carried.
Hearing for Ali H. Alnahdi Regarding the Board’s Proposal-to-Deny of his Application
Ms. Kelly advised the Board that there were two issues to consider, first, did they want to go forward with the hearing, and second, is the credentialing agency that Mr. Alnahdi used for the evaluation of his foreign education acceptable. The Board agreed to go forward with the hearing.
Mr. Nowell called the hearing to order at 5:56 p.m. At its meeting on October 23, 2007, the Board proposed to deny Mr. Alnahdi’s application because he did not appear to meet the requirements as set forth by Title 24, Chapter 26, Section 2606(b) of the Delaware Code and Rule and Regulation Section 10. Mr. Alnahdi has submitted a credential evaluation prepared by Educational Credential Evaluators, Inc. This company is not approved by the Board; however, it did show on the website as being approved. In addition, Mr. Alnahdi received a Masters of Science Degree, Health and Rehabilitation Sciences, sub plan Physical Therapy from the University of Pittsburgh. CAPTE recognized the Doctoral program from the University of Pittsburgh, not the Masters program. It appeared that Mr. Alnahdi’s education is not substantially equivalent to a US first professional degree in physical therapy. Present for the hearing were Mr. Alnahdi and Lynn Snyder-Mackler. Witnesses were sworn in by the court reporter. Verbatim testimony was recorded by the court reporter.
The Board went off the record at 6:10 p.m. to hold deliberations. The Board went back on the record at 6:18 p.m. Mr. Kotrch made a motion, seconded by Mr. Smith, to approve Mr. Alnahdi to sit for the exam. The motion passed by majority vote. Mr. Nowell voted against the motion. The hearing ended at 6:22 p.m. Ms. Kelly will prepare a final order for Board members to sign at the next meeting.

2007 Fiscal Year Statistical Report from Samuel Nickerson, Investigative Supervisor for the Division of Professional Regulation
Mr. Nickerson provided the Board with the 2007 fiscal year statistical report. There were six accepted complaints for FY07.

Ms. Harris made a motion, seconded by Mr. Kotrch, to continue with the same officers. The motion was unanimously carried.
Other Business Before the Board (for discussion only)
The Board had received an email from Karen Coning stating that their home health care agency is purchasing machines for checking lab values for PT/INR in the home (coagulometer). It
involves completing a finger stick for a drop of blood and gives immediate results. Ms. Coning asked if it is under the state practice act for a physical therapist to complete this test. Ms. Coning will be advised that the Board does not offer legal opinions.

The next meeting will be held on Tuesday, February 26, 2007 at 5:00 p.m. in Conference Room A, first floor of the Cannon Building, 861 Silver Lake Boulevard, Dover, Delaware.

There being no further business, Mr. Kotrch made a motion, seconded by Ms. Burris, to adjourn the meeting. The motion was unanimously carried. The meeting adjourned at 6:43 p.m.
